<br />, <br /> <br />'MlNUTES OF THE ARDEN HILamGULAR COUNCIL MEETING <br />Monday, June 8, 1987, 7:30 p.m. - Vi11ase Hall <br /> <br />e <br /> <br />CALL TO ORDER <br /> <br />Pursuant to due call and notice thereof, Mayor Woodburn <br />called the meeting to order at 7:30 p.m. <br /> <br />JIIIROLL CALL The roll being called the following members were <br />__ present: Mayor Robert Woodburn, CouncilJneJnbers Nancy <br />Hansen, Gary Peck, Thomas Sather and Jeanne Winiecki. Also present: Village <br />Attorney James Lynden, Attorney Robert Plunkett, Planner Or1yn Hiller, <br />Treasurer Donald Lamb, Parks Director John Buckley, Public Works Supervisor <br />Robert Raddatz, Clerk Administrator Patricia Horrison and Deputy Clerk <br />Catherine Iago. <br /> <br />AMEND AGENDA <br /> <br />LABOR NEG. Sather moved, seconded by Hansen, that Item #15, Labor <br />Negotiations Report be moved to a Closed Meeting at the <br />end of this evenins's agenda. Hotion carried unanimously. (5-0) <br /> <br />FIRE REPORT Hansen moved, seconded by Peck, that Item #16, Fire <br />Report, be moved to a Closed Heetins at the end of this <br />evening's agenda. Hotion carried unanimously. (5-0) <br /> <br />APPROVE MINUTES <br /> <br />Moved by Hansen, seconded by Peck, that Council approve <br />the minutes of the Resular Council Meeting of May 26th <br />Meeting of June 1st as submitted. Hotion carried <br /> <br />and the Special Council <br />unanimously. (5-0) <br /> <br />eBUSlNESS FROM FLOOR <br /> <br />None. <br /> <br />LINnEY'S TRIANGLE Council was referred to letter from Robert Plunkett <br />dated 6-2-87; regarding Judge Fleming's decision <br />relating to the discharge of the highway easement at Lindey's Triangle. <br /> <br />Plunkett explained the Court decided that the entire parcel is still subject to <br />the highway easement and the parcel is still being used for highway purposes; <br />use of the parcel for occasional recreational use or softball play is <br />consistent with its use for public purposes. He advised Council that today the <br />Board of Commissioners determined the property value, with the highway easement <br />upon it, to be $5,000.00 and awarded appraisal fees in the amount of $300.00 to <br />Kenna's appraiser, for a total cost to the City of $5,300,00. Plunkett noted <br />that this amount was less than the original offer the City had made to Kenna. <br /> <br />Plunkett advised that the respondent has 40 days to appeal the decision; he <br />outlined reasons why, in his opinion, the District Court would not in all <br />probability overturn the decision. He, therefore, advised the Council that they <br />have a reasonable amount of time to abandon condemnation proceedinss, or, to <br />decide to purchase the parcel. <br /> <br />4ItcounCi1 discussed the options of abandoning the condemnation proceedinss or <br />purchasing the parcel. Plunkett and Village Attorney Lynden agreed that if the <br />Council abandoned the condemnation proceedings the City would have the <br />obligation to pay Kenna's attorney's fees; which may exceed the amount <br />determined for the purchase price of the land. Plunkett also pointed out that <br />Ramsey County would have the option to release a part of the parcel for <br />development if the Kennas or any other developers would come to the County with <br />a sufficiently large cash offer; in other words, purchase of the land by the <br />City would prohibit this type of litigation from private parties in the future. <br /> <br />Council asked the Parks Director for his opinion on purchase of the parcel. <br /> <br />Buckley commented that there is not much open space left in this older area of <br />the Village and this parcel should be preserved for residents in the area; also <br />this area is one of the gateways to our community and should be retained. <br /> <br />Rob Plunkett <br />assistance. <br />work on this <br /> <br />thanked Planner Or1yn Hiller and John Buckley for their valuable <br />Council expressed their thanks to Attorney Plunkett for his fine <br />matter. <br /> <br />. Hoved by Peck, seconded by Winiecki, that Council <br />proceed with the acquisition of the property known as Lindey's Triangle, <br />generally located in the area qf Snelling Avenue and County Road E, and, <br />further, authorizes the payment of $5,000.00 to John J. Kenna, Jr., for the <br />parcel of land and $300.00 to Mr. R. J. Tansey, Kenna's appraiser, for payment <br />of appraisal fees. Motion carried. (5-0) <br />
