NO. 248: <br />REZONING 1-2 TO <br />B-2, LEXINGTON <br />AVENUE. C.G.REIN <br /> <br />Moved by Sather, seconded by Peck, that Council suspend <br />the rules, waive the reading and approve ORD. NO. 248, <br />AN ORDINANCE REZONING A PARCEL OF LAND AT LEXINGTON <br />AVENUE NORTH OF GREY FOX ROAD FROM 1-2 (GENERAL <br />INDUSTRY) TO B-2 (GENERAL BUSINESS). Hotion carried <br />unanimously. (5-0) <br /> <br />ORn. NO. 246: <br />SNOWMOBILE &.ALL <br />TERRAIN VEH. ORD <br /> <br />Council reviewed Ordinance No. 246; pertaining to <br />further amendment of the Snowmobile and All Terrain <br />Vehicle Ordinance. <br /> <br />In discussion, Council questioned if the language relating to the hours of <br />operation should be the same in Section 26.35 (b); hours of operation on <br />roadway and Section 26.42; hours of operation within 100 feet of a residential <br />building. <br /> <br />Attorney Lynden suggested deleting the terminology "within the hours of 10:00 <br />p.m. and 8:00 a.m." in Section 26.42 and adding the terminology "except as <br />permitted in Section 26.35." He noted that the entire ordinance is drafted to <br />permit things by exception rather than directly addressing what is permitted. . <br /> <br />Councilmember Hansen advised that some cities have eliminated the operation of <br />snowmobiles on the lakes; she suggested Council consider prohibiting the use of <br />snowmobiles on lakes in Arden Hills. <br /> <br />Councilmember Sather stated that since we share shoreline with the City of <br />Roseville at Lake Josephine staff should review their ordinance relating to the <br />use of snowmobiles to insure compatibility. In discussion, Council determined <br />that the County should review the ordinances since they are responsible for <br />enforcement on the lakes. <br /> <br />Lynden commented that the Ramsey County Attorney should draft a model ordinance <br />for the cities. <br /> <br />Councilmember Winiecki questioned if Section 26.38 had been retained in the <br />ordinance; since Section 26.36 refers to that section. <br /> <br />Lynden stated it was retained and it defines crossing streets. <br /> <br />Council concurred that the Clerk Administrator should forward a copy of this <br />ordinance to Ramsey County Sheriffs Office for their review and request a copy . <br />of Roseville's ordinance for comparison purposes. <br /> <br />Moved by Hansen, seconded by Peck, that Council suspend <br />the rules, waive the reading and approve ORD. NO. 246, AN ORDINANCE AMENDING <br />ARTICLE II OF CHARTER 26 OF THE ARDEN HILLS CODE BY INCREASING PURVIEW THEREOF <br />TO ENCOHPASS RECREATIONAL MOTOR VEHICLES, REORGANIZING SAID ARTICLE, AND ADDING <br />A SECTION REQUIRING MANDATORY PENNANTS FOR SNOWMOBILES. <br /> <br />Peck moved to amend the motion, seconded by Sather, <br />that Council approve the language change in Section 26.42 which deletes the <br />terminology "within the hours of 10:00 p.m. and 8:00 a.m." and insert the <br />terminology "except as permitted in Section 26.35." <br /> <br />Amendment to motion carried. (5-0) <br /> <br />Original motion as amended carried unanimously. (5-0) <br /> <br />Moved by Hansen, seconded by Winiecki, that Council <br />authorize the Clerk Administrator to publish a Summary <br />of Ordinance No. 246, as distributed to Council this <br />evening.
