Th~ .~! nUI'es <br />app.oved as <br /> <br />Minutes <br /> <br />of the Regular Councl I Meeting of May 9, 1966, were <br />submitted. <br /> <br />Elm's Addition Variance Reauest - Case No. 66-13 <br /> <br />VIctor Pomerenke, realtor~ and Alex McNeil, builder, discussed their <br />request for side lot variances on Lots 5,6 and 7, Block I, Elm's <br />Addition. They also stated that Mr. Elms, owner of the tract, Intends to <br />repeat the rest of the lots, making them larger. This replattlng will <br />accommodate the architect's proposed homes and will not reaulre any <br />further side-lot variances. <br /> <br />Mcyor Nethercut snd Attorney Courtney outlined the procedure to be followed <br />in filing an application for a revised plat. Mr. Porne~enk0 left the <br />meetIng to discuss the matter with Mr. Elms, returned at Ii :00 p.m., and <br />advised the Council that they would modify their variance request ta <br />cover only lot 5, Block I. Mr. Elms also Intends to fllB an application <br />fo. a Revised Plat. <br /> <br />T.ustse Hoffmsnn moved that a side-lot variance be granted for Lot 5, <br />Bioc~ I, Elms Addition which will permit a 10' slde-~arcl and 20' sld0- <br />yard aggregate. Seconded by Trustee BJorndahl, carried. The Councl I <br />also stated firmly that no further side-yard variances would be g.a,;tsd <br />in the Elms addition and that the remaining area should be replattBd <br />and/or homBs designed to conform with the VllIsge Zoning Ordinance. <br /> <br />Mayor Nethercut congratulated Vincent Courtney on his recent election <br />as President of the Bar Association. <br /> <br />ATTORNEY COURTNEY'S REPORT <br /> <br />Geroux Rezonln~ - Case No. 66-8 <br /> <br />The attorney reported that he was unable to proceed on this rezoning <br />matter because of insufficient Information, fla~s In the ownership <br />report, etc as detailed In his letter of May 23 to the Council. Ad- <br />ministrative Clerk Stromquist was requested to contact Mr. Geroux, giving <br />him a copy of Attorney Courtney's letter, and Informing hIm that a <br />correct legal descrIptIon and complete ownership report were needed. <br /> <br />. Frontage Road Me I ntanance <br /> <br />Action on the maintenance agreement was deferred until the June 13 <br />meeting. Attornev Courtney requested that William Hlte check the <br />Village insurance concerning the Indemnifying provision (assumed contract <br />liability coverage). Engineer Lund will complete his study of the <br />agreement by the next meeting. <br /> <br />Municipal Plannln~ Act <br /> <br />Attorney Courtney reviewed the powers of the Board of Appeals. Since <br />the Village has a Board of Appeals which Is separate from the Planning <br />Commission, both bodIes ~III have to consider variance requests with <br />the Council to take action after the ne~t scheduled meeting 01 the <br />PlannIng Commission.
