~ -~ . -- MINUTES OF THE REGULAR COUNCIL ~ VIlLAGE OF ARQEN HILLS Monday - Januat-Y 10, 1966 MEETING . Meeting was called to order by Mayor Nethercut at 8:00 P.M. Roll Call: Present - Mayor Nethercut, Trustees Hoffmann, Crepeau, Dlmen and BJorndahl. Absent - None Also Present - Village Attorney VIncent P. Courtney, Engineer Donald Lund, Treasurer Worth G. Read, Heating Inspector Virgil Keller, Administrative Clerk LorraIne Stromquist and Deputy Clerk Florence Honan. The minutes of the Regular Council Meeting of December 27, 1965, were approved as submitted. ....Buslness from the Floor VirgIl Keller, Heating Inspector, Informed the Council of a request from Charles Neitzel to Install three chimneys for the double bungalow he Is constructing on County Road 0; these chImneys are not In accordance wIth the OrdInance and would requIre a variance approval from the CouncIl. There was discussIon by the CouncIl, Mr. Keller and Mr. J05. McKeon, an Interested resident concerning the various types of chImney construction. Trustee Crepeau moved, seconded by Trustee Olmen, that al I three chIm- neys be of the metal asbestos type; motion carrIed. REPORT OF ATTORNEY COURTNEY Husbv Contract Attorney Courtney Informed the Council that the Husby contract has been signed and he has checked wIth the County Assessor's office to determIne the status of the taxes. He was Informed that the taxes will be abated 3= the transaction was completed In 1965. However, the apportIonment resolution should be prepared. Matter referred to Attorney Courtney and Engineer Don Lund. Peifer Easement Clerk LorraIne StromquIst Informed Attorney Courtney that the PeIfer easement check for $250.00 was ready. Attorney Courtney informed the CouncIl that he had an appoIntment with the Pelfers after this meeting to close the trans~ctlon and wouldr therefore, leave the meeting early If possIble. Trustee Crepeau moved, seconded by Trustee BJorndahl, that the PeIfer easement check be approved; motIon carried. CummlnQs Lane street Improvement Attorney Courtney Inform~d the CouncIl that the 6 month period for CouncIl action concerning the Cummings Lane Street Improvement will expIre thIs month. Attorney Courtney read a Resolution as prepared by him ordering Street Improvement No.7 (CummIngs Lane). Trustee elmen moved adoptIon of the resolution, as attached, secon ded by Trustee Crepeau; motIon carried. . The Council authorized BanIster EngineerIng Company to prepare the plans and specIfications for the Improvement. I "'P.~2d VacatIon Attorney Courtney Informed the CouncIl that he has receIved a new petItIon which Includes the Hansonts sIgnatures requesttng the vaca- tion of a road easement on the Hanson property. He stated that every- thIng Is now In order for a publIc hearIng, and he has prepared a resolu- tIon se~lng the date of the publIc hearIng for January 31. Trustee Hoffmann Informed the CouncIl that the PlannIng Commission has recommended that the easement not be vacated until further study Is given the matter by the CommIssIon. Tbe CommIssion also would like to meet wIth the VIllage Engineer concernIng the matter. Attorney Courtney advIsed goIng ahead with the publIc hearIng and suggested delayIng CouncIl actIon untIl further study. Mayor Nethercut suggested settIng but Trustee BJorndahl stated that the loan on the property and thIs the publIc hearIng date on February 14, Mr. Hanson Is havIng a problem wIth delay would further 1nconvenlence hlm~ . -1-
