<br /> . AGREEMENT FOR CURBSIDE RECYCLING SERVICES <br /> This Agreement, made as of January 8, 1990, between the City of Arden <br /> Hills (hereinafter the "City") and Easy Recycling, Inc. , (hereinafter the <br /> lIContractor") . <br /> The City and the Contractor agree as follows: <br /> 1. DEFINITIONS <br /> 1.1 "Area" means the entire area of the City of Arden Hills. All <br /> boundaries, unless otherwise noted, fall on the center of the named <br /> street. <br /> 1.2 "Recyclable material!' means newsprint and non-glossy paper, <br /> cardboard, glass bottles and jars, mixed aluminum and bi-metal <br /> beverage containers, other aluminum, "tin" food cansJ miscellaneous <br /> metals and other materials as mutually agreed upon by the City and the <br /> Contractor. <br /> 1.3 "Recycling Collection" means the taking up of all recyclable <br /> materials accumulated at residential properties (including multi-unit <br /> dwellings and apartments, up to 24 units) and the transporting of the <br /> recyclable materials to a site where they can be processed for the <br /> marketplace. This site shall be at an area designated by the <br /> Contractor. <br /> . 2. SERVICES TO BE PERFORMED <br /> 2.1 The Contractor shall collect all recyclable materials on the <br /> following days: <br /> If this scheduled day should fall on a national holiday, the alternate <br /> date for collection will be the following day. The City will provide <br /> the Contractor with maps of the district area, noting areas for <br /> recycling pickups and areas where pickup is not desired and/or <br /> necessary. <br /> 2.2 The term of this Agreement shall be from January 1, 1990 to <br /> December 31, 1990. <br /> 2.3 The City and Contractor acknowledge that timely performance of <br /> collection services is essential to the success of the recycling <br /> program. The work shall be done with forces which are adequate to <br /> insure the satisfactory co"llection and disposal of said materials at <br /> all times and failure to perform may be excused only by adverse <br /> weather conditions or similar hindrances which on other work might be <br /> regarded as an II act of providencel!. In the case of such an event, the <br /> Contractor will notify WCCO Radio and KSTP Radio by 6:00 A.M. to <br /> . announce the postponement and provide information on a substitute <br /> date. Generally, the Contractor will perform the postponed collection <br /> on the Friday following the scheduled collection day. <br />
