The property is zoned B-3, Service Business District <br />and is guided as Commercial. <br />2. CONDITIONS OF APPROVAL. <br />A. The City hereby approves the Development on condition that the Developer enter <br />into this Agreement; obtain a Conditional Use Permit for Vehicle -Motorized Service which <br />includes a car wash as a principle use as required by City Code Section 1355.04, Subd. 3, of the <br />Arden Hills Zoning Code; furnish the security required by it; and record the CUP and this <br />Agreement, together with any appropriate consents prior to the City's issuance of a building permit <br />for, or development of, the Subject Property, in the Office of the Ramsey County Recorder and <br />Ramsey County Registrar of Titles, as applicable, within sixty (60) days after the City Council <br />approves the Conditional Use Permit and the Development. <br />B. The City hereby approves the Development on condition that the Developer <br />Implement the recommendations listed in Resolution No. 2024-011 Approving a Conditional Use <br />Permit dated February 12, 2024. <br />C. The City hereby grants approval to the Development (identified as Plans A through <br />J in paragraph 7 of this Agreement); as adopted on February 12, 2024, by Resolution No. 2024- <br />011, and compliance with the terms and conditions of this Agreement and all other City <br />requirements which are in effect. The specific conditions, requirements, and terms of approval are <br />as set forth in City Resolution 2024-011, adopted by the Arden Hills City Council on the 12t' day <br />of February, 2024. <br />3. RIGHT TO PROCEED.
