ROLL CALL The roll b"ing called the following members were present: <br /> Mayor Thomas Sather, Councilmembers Nancy Hansen, Paul <br /> Malone and JoAnn Growe. Absent: Councilmember Thomas Mahowald. Also present: <br /> Public Works Supervisor Dan Winkel, Clerk Administrator Gary Berger and Deputy <br /> Clerk Catherine Iago. <br /> EASEMENT Council was referred to a report from Public Works <br /> ENCROACHMENT Supervisor Winkel dated 1-18-90, regarding a survey <br /> conducted along Katie Lane and Stowe Avenue to identify <br /> encroachments on City easements by landscaping and fencing. <br /> Winkel displayed pictures of the 20 ft. sewer utility easement located along the <br /> north property line on Katie Lane properties and the southerly property line of <br /> Stowe Avenue. He explained with the current encroachments located on the easement <br /> it is difficult and in some cases impossible to maneuver the Jetter truck along <br /> the easement to repair sewer line problems or perform routine maintenance. <br /> The Public Works Supervisor noted that it appears the fencing along the southerly <br /> property line for the Stowe Avenue residences is located 2 ft. into the Katie <br /> Lane easement and not on the actual property line. He stated this may have <br /> occurred because the first resident to place a fence along this property line <br /> incorrectly located the fence and future fencing was also incorrectly located. <br /> Winkel advised this is the first area to be surveyed since the residents have <br /> eyperienced some sewer utility pr"~lems in thie area and encroachment offenses <br />. are commonplace. <br /> Supervisor Winkel also referred Council to a letter from Attorney Filla, dated <br /> 12-8-89, which lists some items for Council consideration in determining the <br /> respective rights of the City and the property owners regarding encroachments of <br /> this nature and contains a "draftll letter regarding subsequent removal of the <br /> encroachments from dedicated easements. <br /> After discussion, Council concurred that it would be appropriate to begin <br /> establishing some criteria for elimination of easement encroachments in the area <br /> identified along Katie Lane and Stowe Avenue_ Council requested staff review any <br /> permits issued for fences located in this area to determine if persons were <br /> allowed to construct encroachments within the easement areas and submit the <br /> findings to Council on Friday, January 26. <br /> Council also noted that a process should be established to insure easement areas <br /> are clearly identified for residents seeking building permits in the future and that <br /> staff identify and notify persons applying for the permits of any such easements. <br /> It was the consensus of the Council to discuss the materials submitted by staff <br /> at a future worksession meeting; it was suggested that after review and <br /> establishment of criteria for elimination of easement encroachments, a meeting be <br /> scheduled with the residents of the Katie Lane/Stowe Avenue area to discuss the <br /> easement problems. <br /> Attorney Filla commented there may be circumstances arising in some encroachment <br />. cases that are unique and Council may consider such cases on an individual basis. <br />
