The City currently prohibits the off-sale of <br /> intoxicating liquor after 8 p.m. on Monday, Tuesday, Wednesday <br /> . and Thursday. The City has the authority to extend those hours <br /> of sale until 10 p.m. In order to accomplish this, the City <br /> . would have to adopt an ordinance amending Section 3-16(c) of the <br /> Arden Hills Code. <br /> Current State Law also permits Cities to authorize the off- <br /> sale of intoxicating liquor on New Years Day and on the Fourth of <br /> July between the hours of 8 a.m. and 10 p.m. unless those days <br /> fall on a Sunday. In order to accommodate this change, the City <br /> would have to amend Section 3-16(d) of the Arden Hills Code. <br /> In all other respects, the City's Regulations are <br /> consistent with the State Law regarding the hours of sale for <br /> off-sale intoxicating liquor licensees. The City can be more <br /> restrictive than State Law. <br /> In reviewing the Arden Hills Code, I also noted what appears <br /> to be a typographical error in Section 3-16(d). I believe the <br /> reference in that Section should be to "subsection 3-16(c)" <br /> instead of to "subsection 3-16(d)". If the City chooses to <br /> change its Regulations regarding either the hours of sale or days <br /> of sale, I will insert appropriate language in the ordinance to <br /> correct this error. <br /> If you have any questions, please contact me. <br /> .
