<br /> . <br /> CONSIDERATIONS: <br /> . 1. The County and City have retained easements needed for public <br /> purposes. (Utility easements are shown on a separate <br /> document--attached.) The City Engineer's letter concerning these <br /> easements is attached. <br /> 2. The property is in the R-2 District and both lots exceed the <br /> minimum requirements--in fact, the smaller lot approximately meets <br /> the R-l District requirements for lot width and area and exceeds <br /> the R-l depth requirement. <br /> 3. Due to the wide variation in front yard setbacks in the vicinity, <br /> the Zoning Administrator will determine the setback requirement for <br /> Lot 2, as provided for in the Zoning Ordinance, Section <br /> VI ,B, (1) ,(a). <br /> RECOMMENDATION: <br /> The proposed division of Lot 3, Rohleder's Home and Garden Addition, <br /> meets all ordinance requirements, has been found by the City Engineer to <br /> meet easement and filing standards, and will provide an attractive new <br /> home site. The staff therefore recommends approval of the division <br /> subject to: <br /> 1. Successful transfer of the excess right-of-way to Mr. Robinson and <br /> . reimbursement to the City of costs incurred in the lengthy review <br /> and negotiation process. <br /> 2. Receipt and acceptance of the easement documents by the City prior <br /> to issuance of the building permit for Lot 2. <br /> 3. That no yard (building setback) variances be allowed when the house <br /> on the lot is constructed. <br /> 4.
