That the two existing lighted signs on the entrance canopy to <br /> the hoted be removed. <br />Motion carried 6-2. (Opposed Winiecki and Probst). <br />CASE #90-06, Mr. and Mrs. Jerry Mansergh, 3947 Rolling <br />MANSERGH, LOT Hills Road, were present to request a lot <br />SPLIT split for their property, legally described as <br /> Lot 7, Block 29, Rolling Hills No.6. Planner <br />Bergly noted that the 80,107 square foot lot is proposed to be <br />divided into Tract A, with 45,650 square feet and the existing <br />house, and Tract B, which would contain 34,457 square feet. The <br />applicant proposes to construct a new home for himself on Tract B <br />and will sell the existing home. Bergly reviewed his memo dated <br />May 2, 1990. <br />Peterson noted a pipeline on the survey and questioned what type <br />it was. Mr. Mansergh noted it is a natural gas pipeline. Martin <br />asked what the minimum frontage is and Bergly responded that 20 <br />feet is the minimum frontage on a public street. Martin also <br />noted that a plat has to be filed before a new home may be . <br />constructed and he asked if this is a plat or a registered land <br />survey (RLS) . Mr. Mansergh noted that this is a registered land <br />survey. <br />Winiecki moved, seconded by Zehm, to recommend to Council that <br />Case No. 90-06, lot division for 3947 Rolling Hills Road, be <br />approved and the lot divided into two lots with the following <br />conditions: <br />1. That the city Engineer and Attorney review and approve the <br /> division documents prior to filing and that necessary <br /> easements are secured. <br />2. That the City Engineer establish the minimum floor elevation <br /> to which sanitary sewer service can be provided. <br />3 . That Rice Creek Watershed District approve the proposed <br /> development plan and that related requirements are met by the <br /> owner prior to issuance of a building permit. <br />4. That the proposed residence on Tract B be placed west of the <br /> point where Tract B is 95 feet wide. <br />5. That park dedication requirements for the additional building <br /> site be met prior to issuance of a building permit. . <br /> ---------- <br />
