Army until he had support of the Arden Hills city Council. <br />McGraw distributed copies of his proposed recommendations to the <br />members, requesting that these recommendations be forwarded to <br />the city Council for their May 14 meeting. <br /> <br />Chair Probst noted he had read the proposal earlier in the day <br />and suggested placing this back on the June Planning agenda for <br />further discussion. He felt it was not fair to ask for the <br />Commission's recommendations on this short notice. Probst also <br />suggested that funds be allocated in the budget to research the <br />facts before action-is instituted. It was unclear if a city <br />could sue the government. <br /> <br />Carlson felt this matter should proceed immediately to the <br />Council for their decision. He did not want the matter to sit <br />for another month. <br /> <br />Martin concurred with Probst's observations and suggested that <br />this be held off from the Council until an investigation as to <br />the legal feasibility of taking action has occurred. <br /> <br />Winiecki asked how an investigation would be different from <br />pursuing this course of action. <br /> <br />McGraw said whatever we do, we should do it right. We need <br />. professional help and funding, but let's not delay after proper <br />advice is received. We should get the Council's attention so <br />that action can be taken. <br /> <br />Winiecki felt that items 1 - 3 were reacting to past actions by <br />TCAAP and that the most expeditious item is #4, "that the Arden <br />Hills city Council take necessary action to insure that the city <br />of Arden Hills has the right of first refusal to the land now <br />occupied by TCAAP". <br /> <br />Martin stated he favord having the City Attorney investigate what <br />our options are within the framework of the suggestions McGraw <br />had presented, just to find out where we are in the pecking order <br />between other federal agencies, the state, county, and us so that <br />when the Army decides to do something, we already know what our <br />rights are; just to have the city Attorney determine what our <br />rights are so that we can enforce them, so somebody doesn't slide <br />something by us. <br /> <br />Winiecki felt this was a motion and she seconded the motion. <br /> <br />After further discussin, Martin moved, seconded by Winiecki, that <br />the Planning commission recommend to council that they instruct <br />the City Attorney to investiate what rights the City has as to <br />recompense in lieu of taxes or otherwise for past uses on the <br />. TCAAP site and what rights the City has to force different uses <br />
