(3-0) PUBLIC <X.M-1ENTS REQUFSr EXTENSION i Warren Forslund, 3197 Shorewood Drive, appeared before BlDG. CCMPLEl'ION Cbuncil to discuss the citation issued in reference to a violation of the Building Corrq:lletion Ordinance on his property an::l. request an extension on the court date set for January 7, 1991, relative to this matter. Forslund explained the complexity of the procedure to install the roof at his residence an::l. stated he has worked continuously to complete the project. He stated that unforeseen monetary problems an::l. weather have harrq:lered completion of the project. Forslund requested an extension for completion of the project to October 15, 1991, an::l. dismissal of the trial date of January 7, 1991. Several of the neighbors residing on Shorewood Drive were present to attest to . the work being done on the project an::l. to support the request for continuance to complete the project. The Clerk Administrator explained the first Wilding permit for the project was issued on May 31, 1981. He noted the enforcement of the ordinance was based on a complaint received regarding this project. Berger stated the Building Inspector followed the ordinance guidelines as relate to notification of violation an::l. time-frame for completion of the project. Jim Cooper, 3191 Shorewood Drive, an::l. Ben Franklin, 3202 Shorewood Drive, were present and supported. the request for continuance on the Wilding permit for this project. There were approx:i1nately thirty persons present fram the neighborhood an::l. none S{Xlke in opposition to the request for additional time to complete the project. eouncilmernber Mahowald explained the ordinance was enacted to protect residents against violations of the building ordinance which create nuisance situations an::l. reduce property values. He indicated the stron;)' support fram neighbors indicates this situation is not a nuisance, however, granting an extension may set precedent for other violators. Malone moved, seconded by Mahowald, to direct staff to review the Building Corrq:lletion Ordinance language to determine the appropriateness of granting an extension to Mr". Forslund, and report to Council at the January 2, 1991 meeting, an::l. noted that review of this matter does not . guarantee the extension will be granted. Motion carried unanimously. (3-0)
