A and B, to <br /> be the development plan, and based on the findings, both as listed in the <br /> Planner's report dated 12-5-90. Motion =ied unanimously. (3-0) <br /> Malone moved, secorrled by Mahowald, to accept the revised <br /> site plan, dated October 19, 1990, f= the first stage and final development <br /> stage, based on the findings of the Planner as outlined in his report dated <br /> 12-5-90, and incorporating by reference all the site and phasing plans provided <br /> by the applicant. Motion =ied unanimously. (3-0) <br /> Mahowald noted the applicant indicated willingness to install a ba=ier of senne <br /> type or landscaping along the south property line; questioned if this natter <br /> should be incorporated into the corrlitions. <br /> Malone carrnnented the City Engineer will approve the grading and drainage plan and <br /> thus by linplication the applicant offers to insure that drainage is not a problem <br /> to the south. <br /> Malone noted the Planning Commission discussed the zoning ordinance reference to <br /> lighting and the differentiation between the luminaire and the lens. He stated <br /> the ordinance requires the lumina ire not be visible frcnn the street and the <br /> Planning Commission requested the lens not be visible fram the street; questioned <br /> if this is feasible. <br /> . Bergly stated it would not be feasible to require the lens not be visible; the <br /> lighting fixtures will natch the property to the south of this site. <br /> Foster advised he is willing to work with staff to meet lighting requirements. <br /> Malone moved, secorrled by Mahowald, to require that the <br /> following general corrlitions be met prior to issuance of a building permit, for <br /> this site: <br /> .,.... .: .,~. <br /> A. That the two lots be combined and that appropriate utility and drainage <br /> easements be granted to the City, subject to administrative approval. <br /> B. That a document providing a pennanent. access easement across the Control Data <br /> Corporation drive frcnn Lexington Avenue to the west parking lot, and <br /> preferably to Fernwood Avenue, be approved the City Attomey. <br /> C. That easement be granted for fire lanes as required. <br /> D. That the city Engineer approve the grading and drainage plan and that the <br /> Rice Creek Watershed District issue an appropriate permit. <br /> E. That the City park dedication requirements be satisfied. <br /> F. That a landscaping borrl be posted in an amount to be determined by the <br /> Planner . <br /> Motion =ied unanimously. (3-0) <br /> Council1nember Malone advised the applicant that the park dedication is to be <br /> negotiated with Council1nember Mahowald, and that the drainage plan approval <br /> includes responsibility of the owner to provide any co=ective measures necessary <br /> . if drainage problems occur on adjacent properties. <br /> CASE #90-17; MINOR Council was referred to the Planner's report and <br /> SUBDIVISION, 1245 Planning minutes dated 12-5-90, relative to the <br /> NURSERY HILL cr, application for a minor sulxiivision at 1245 Nursery <br /> EIBENSI'EINER Hill Court, Robert and Marcel Eibensteiner. <br />
