Plan Evaluation <br />1. Chapter 13, Zoning Regulations Review <br />Section 1325 — General Regulations, 1325.02 Accessory Uses, Subd, 6 Lower -Potency Hemp <br />Edible Sales <br />A. Lower -Potency Hemp Edible Sales shall be a Conditional Accessory use only permitted in <br />the B-2 General Business, B-3 Service Business, B-4 Retail Business, NB Neighborhood <br />Business and GB Gateway Business Zoning Districts where the principal use is Retail Sales <br />& Service, Restaurant, or Service Station, the business has a liquor or tobacco license issued <br />by the City, and when such accessory use is clearly incidental to the principal use. <br />The Subject Property is located within the B-3, Service Business Zoning District. The <br />Applicant's principal use is Retail Sales & Service. The Applicant has a liquor license <br />issued by the City. The Applicant has stated that a limited selection of lower -potency <br />hemp edible products would be available within the liquor store location. Additionally, <br />the products would be located in one section of the liquor store location, identified as <br />the "Metro End Cap Only". The end cap is identified to have three shelves and would <br />occupy a small portion of the 1,724 square foot liquor store space. Based on how the <br />Applicant has described the proposed sale of lower -potency hemp edible sales, this <br />would be an accessory use that is incidental to the principal use of Retail Sales & <br />Services within Cub Discount Liquor. <br />B. Applicants for Conditional Accessory Lower -Potency Hemp Edible Sales shall follow the <br />conditional use permit procedures prescribed in Section 1355.04, subd. 3, and Appendix A, <br />Procedure Manual. The City shall review a site plan and specifics of the proposed lower - <br />potency hemp edibles business. <br />The Applicant has submitted a Conditional Use Permit application to allow for the sales <br />of lower -potency hemp edible sales as a conditional accessory use on the Subject <br />Property in accordance with Section 1355.04, subd. 3 and Appendix A, Procedure <br />Manual. The Applicant provided a site plan and floor plan of the Subject Property. The <br />Applicant identified the Cub Discount Liquor location on the floor plan as where the <br />sales would take place and with a square footage of 1,724 square feet. The floor plan <br />shows that the lower -potency hemp edible sales will occur alongside liquor sales and is <br />separate from the grocery sales which comprises the majority of the Subject Property. <br />The Applicant shared in a narrative how the proposed sale of lower -potency hemp <br />edibles would be managed at the Subject Property. The Applicant outlined how the <br />selection of products would be sourced through existing vendors and in adherence to <br />state guidelines. Also noted is how the sales process will include multiple prompts that <br />includes ID scanning and require the customer to confirm they are aware they are <br />purchasing a product containing lower -potency hemp edibles. Employees at Cub <br />Discount Liquor are to receive THC awareness training through an internal training <br />tool and managers will receive additional off -site training. <br />Section 1355.04 — Procedural Requirements for Specific Applications <br />A public hearing for a CUP request is required before the request can be brought before the City <br />Council. The applicant or its representative shall be given the opportunity to appear before the <br />Planning Commission to answer questions or give explanations regarding the proposal.
