2007 to allow for additional signage and again in 2012 to allow for the construction of a drive -up <br />window for the existing pharmacy located within the building and associated signage. A <br />Conditional Use Permit was also issued for the drive -up window use. <br />Proposed Use: <br />The Applicant, Cub Discount Liquor, submitted a Conditional Use Permit application to allow <br />for the sales of lower -potency hemp edible sales as a conditional accessory use on the Subject <br />Property, within Cub Discount Liquor, which occupies 1,724 square feet of the building. The <br />Applicant holds a liquor and tobacco license issued by the City. The Applicant intends to offer a <br />limited selection of lower -potency hemp edible products that will be sold utilizing a multi - <br />prompt sales process including ID scanning, in line with the company policy for all alcohol sales. <br />Customers will also be prompted to confirm that they are aware they are purchasing a product <br />containing THC. The products would be available for purchase within the Cub Discount Liquor <br />store and would not be sold in the Cub Foods grocery store or Cub Pharmacy. Employees at Cub <br />Discount Liquor will have gone through THC awareness training and are encouraged to ask or <br />refer questions to the store managers, who will receive additional off -site training. <br />Approvals: <br />1. Conditional Use Permit <br />A Conditional Use Permit (CUP) is required for the conditional accessory use of lower -potency <br />hemp edible sales. Lower -potency hemp edible sales shall be a Conditional Accessory use only <br />permitted in the B-2 General Business, B-3 Service Business, B-4 Retail Business, NB <br />Neighborhood Business and GB Gateway Business Zoning Districts where the principal use is <br />Retail Sales & Service, Restaurant, or Service Station, the business has a liquor or tobacco license <br />issued by the City, and when such accessory use is clearly incidental to the principal use. <br />City Code Section 1355.04 Subd. 3 of the Arden Hills Zoning Code lists the criteria for <br />evaluating a Conditional Use Permit. The Planning Commission and City Council should <br />consider the effect of the proposed use upon the health, safety, convenience and general welfare <br />of the owners and occupants of the surrounding land and the community, in general, including <br />but not limited to the following factors: <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and <br />other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; <br />6. Adjoining land values; <br />7. Park dedications where applicable; <br />8. Orderly development of the neighborhood and the City within the general purpose and <br />intent of the Zoning Code and the Comprehensive Development Plan for the City. <br />Under state law, a conditional use is a use that is generally allowed in a designated district upon <br />the applicant showing that the standards and criteria stated in the ordinance will be satisfied. <br />Conversely, if the applicant is unable to show that the ordinance standards are met, the <br />application can be denied, but because the use is listed as permitted, the City's discretion is more <br />limited in these matters than in a comprehensive plan or rezoning application. <br />Page 2 of 5 <br />
