July 13, 1992 <br /> TO: Mayor and Councilmembers <br /> FROM: Dale Hicks <br /> RE: Vacation of easement along Old Snelling between County Road <br /> E and south to Hamline intersection with Snelling Avenue <br /> I don't want to discuss this now during Council Comments, but want <br /> you to be aware of this issue. Mr. Bill Chapman, 1475 Skiles Lane, <br /> called and met with me a week ago. He wants the City to request <br /> the County to vacate a portion of the easement along Old snelling <br /> Ave. He has talked with the County, and they have told him they <br /> would vacate the easement to the city if the city requests same. <br /> They will not, however, initiate the action. There currently is a <br /> 200 foot easement with the road taking approximately 86 feet. He <br /> wants to have 50 feet vacated on either side of the street and <br /> proposes ,that the city in turn offer it for sale to adjacent <br /> property owners. He then said "We could get about 10 additional <br /> homes in the area. <br /> I made the following comments: <br />~ 1. I don't know how 10 lots of reasonable configuration could <br /> be platted with this vacation of 50 feet on either side of the <br /> street, but would like to see the plat drawing of the area. I <br /> don't believe the City would want a series of long, narrow lots <br /> alongside either side of the street. <br /> 2 . I don't believe the City should request vacation of only <br /> a portion of the easement, but all of it and only after Mr. John <br /> Kenna has filed with the County whatever is necessary to release <br /> his first right to the property should the county vacate the <br /> easement. Mr. Kenna is the fee owner of the triangle area in the <br /> Northeast corner of the intersection of Old Snelling and County <br /> Road E. If the County were to vacate a portion of the easement, <br /> this action would set a precedent and Mr. Kenna could request <br /> vacation of the triangle area. He has petitioned the County for <br /> that vacation twice during the past 15 years. Arden Hills <br /> currently uses that area for passive recreation. Mr. Chapman knows <br /> Mr. Kenna; I suggested he first see if Mr. Kenna would release his <br /> interest as fee owner. <br />~ <br />
