Time: Immediately after curb was poured. Sept.-oct. I called Mark Graham and met him at my house the same day. While Mr. Graham was there, at my request, one of the workmen re- set the forms so that the concrete apron would run in a straight line toward my concrete slab. 2. Time: A few days later. About early October. I called Mark Graham and met with an associate he sent and the job superintendent for Midwest Asphalt. In the presence of the superintendent, Mr. Graham's associate agreed to grade my driveway in a straight line to my concrete slab, to replace the class 5 base, to re-grade my lawn, and re- sod or seed the lawn at his discretion. I agreed to accept the probable loss of three trees and to pay Midwest an additional $800 for resurfacing the entire driveway. . Mr Graham arrived just as the discussion was ending and his associate told him that the matter had been settled. The meeting then broke up with no further discussion. 3. Time: About two weeks later. Mid to late October. I saw a blue line on my driveway about 40 feet in from the apron. I sensed that the agreement was not going to be kept. No work was done on any driveways and the October 31 storm came. 4, Time: About early March. I went to the city hall and met with Gary Berger. We stood in the council chambers and discussed all of the issues I was concerned about. I asked him to come and take a look at my driveway. He said he did not have the time then but that he would get back to me later. He never did. 5. Time: About mid-March. I went to the city hall and asked to get on the council agenda. . Mr. Berger apparently heard me and came out of his office and set a date to meet at my house.
