KRIESEL, BUILDnG OFFICIAL <br /> stJBJEX:T: VIOLl\TICfi OF SPECIAL USE PERMIT--cllSE ro. 71-21 1\ND 1\MENDED <br /> SPECIAL USE PEIlMIT--cllSE ro. 75-6, ARDEN Ml\K:.R MOBILE Haa: <br /> PARK <br /> In January 1991, the Metropolitan Waste Control Connnission (MWCC) <br /> directed all 105 user communities to conduct a Service Availability <br /> O1arge (SAC) audit for unidentified SAC =edits. A =edit(s) is <br /> available upon the demolition or removal of a building from a site. <br /> Upon this direction I =nducted the audit by reviewing all building <br /> permits issued from January 1, 1973, through the present. <br /> Through the =urse of my audit I found that no SAC was paid at the time <br /> of issuance of building pennits for the mobile home park. Further <br /> investigation has found no SAC was ever paid. These findings were <br /> . presented to MWCC staff, who reviewed their files substantiating my <br /> findings. <br /> On FebJ:uary 12, 1992, MWCC declared "that effective JANUARY 1, 1992, any <br /> mobile homes moving onto those sites (Le. tenant changes) must have SAC <br /> charges collected and remitted to the Metropolitan Waste Control <br /> Carmnission." <br /> "The MWCC deals directly with the 105 user communities on SAC issues. <br /> The MWCC =llects SAC from local goverrnnent units generally based on <br /> building permits issued and industrial SAC applications suhnitted. Each <br /> municipality is responsible for remitting the appropriate amount of SAC <br /> revenue to the MWCC. Corwersely, the MWCC grants SAC =edits to <br /> mmicipalities when a new use is established on a site where SAC was <br /> previously paid or grandparented into the system." <br /> Through my investigation, a review of Special Use Pennit---case No. 71-21 <br /> and Amended Special Use Pennit-case No. 75-6 language was found <br /> requiring the permittee (owner/nanagernent) to obtain location permits <br /> and to notify the Clerk-1Idrninistrator in writing within 10 days, of all <br /> mobile homes that became unoccupied and setting forth the date vacated. <br /> Permits have only been obtained for initial construction of the lots. <br /> The Clerk-Administrat= has never been notified of vacancies. <br /> . <br />
