After further review of ci ty records, we <br />conclude that none of the units in the 200 unit expansion of the <br />Arden Manor Mobile Home Park were connected to sewer as of December <br />31, 1973, and therefore, none of the units are exempted from the <br />Service Availability Charge (SAC). Further, that any sewer <br />connection permits issued in December, 1972 for these units are not <br />sufficient to exempt the SAC charge. <br /> <br />. The SAC policy was instituted effective January 1, 1973. Any homes <br />already connected to the system were "grandparented" into the <br />system, meaning payment was not collected. In the case of mobile <br />homes, connection to the sewer system is deemed when pads are <br />installed. <br /> <br />When this issue surfaced., there was question as to when the 200 <br />unit expansion was completed. The following documentation supports <br />the MWCC conclusion that the 200-unit expansion was connected in <br />1975. <br /> <br />1. A letter dated October 25, 1972 addressed to Mr. James Adams <br />indicating .that homes not connected to sewer as of January 1, 1973 <br />will be assessed SAC. A footnote indicating that this would apply <br />to the "expansion" was located at the bottom of the letter. <br /> <br />2. The original permit number 71-21 dated February 12, 1973 <br />permitting the development of 200 "movilla type" mobile homes. <br />(There were also several amendments to this original permit <br />spanning several years.) <br /> <br />3. A schedule of completion for the 200 units dated 1975. <br /> <br />There are virtually no records that the connection took place prior <br />. to 1973. There were connection permits issued in December 1972, <br />however, it is unclear for which units they were issued.
