<br /> Arden Hills Council 6 Harch 30, 1992 . <br /> COUN C U".~C~O~MMEl!'I' s <br /> GOUNtY RQ~t'.lLE~~AFl'TY~NCERNS <br /> Councilmember Hicks stated that at a recent Par-ks l.':ee_ting, <br /> residents brought forth County Road E safety C0~C::~;::;'3 ; he <br /> anticipated those concerns will be forwarded to Council Hit ;~ <br /> a recommendation relating to the concerns. <br /> TURNERS CHA~)TAELE GAMBkUELPRE~MISE PE}!\!1.LT. <br /> Councilmember Hicks referred to a March 27, 1992 letter f r or:: <br /> Turners Gymnastics Center and asked Attorney Filla to <br /> comment on whether Turners Gymnastics is in compliance with <br /> charitable gambling regulations. <br /> Attorney Filla stated that Turners, as a condition of their <br /> charitable gambling operation permit must, 1 ) Be a non- <br /> profit organization, 3) Use 50% of expenditures in the trad", <br /> area, 3) Meet the state's defini t i on of "lawful purpose". <br /> He stated that in his judgment, Turners has not met those <br /> conditions and he has contacted representatives of Turners <br /> in this regard. . <br /> Fill a furt.her 'commented that he did not think the problem <br /> with Turners was in any way created by the City, that <br /> Turners was 'I'Jell aware of the conditions of the pe:-mit.. ::e <br /> recommended that since conditions have not been m,,=,t, Counci 1 <br /> withdraw the City's approval of the permit and advise the <br /> Charitable Gambling Control Board of the action, <br /> Councilmember Mahowald commented that such action wou:c <br /> require Turners to halt their operation. He asked if it <br /> would be appropriate for the City to designate a time period <br /> for investigation rather than take action to withdraw <br /> Turners' permit at this time. Fill a reiterated that <br /> conditions of the permit were clear and the organization is <br /> not in compliance, <br /> Mayor Sather added that he thought Turners charitable <br /> gambling permit expires on or about 3/31/92 and he was <br /> disappointed that Turners waited until the elevent~, hour to <br /> report expenditures which do not appear to be acc=eptable. <br /> Councilmember Hicks asked counsel if there would be ~. <br /> a "lme <br /> peri od in which Turners could "appeal". 1'.ttorney Filla said <br /> he was not aware of any "appeal" period. Filla f~~rtl-'...er <br /> commented that Turners was asked to report their <br /> expenditures well in advance of the expiration date of t.heir . <br /> permit and they did not respond until March 27, 1992, <br /> ---- <br />
