The City as a whole lS picking up the largest <br /> share of the project costs. <br /> Resident Kurt Lawrence: Years agol the developer, had <br /> planned to do what is being done now but the City consultant <br /> at the time told him it was not needed. The City has not <br /> researched the background of this issue. <br /> Attorney Filla: I disagree with the statements just made by <br /> Mr. Lawrence; the City has researched the background <br /> information available and has pursued the developer and <br /> former engineers. To my knowledge, the developer never did <br /> receive consent from Mr. Reiling to drain onto the Reiling <br /> property. <br /> Mayor Sather: The public needs to be reminded that it was <br /> the residents of the Keithson area who asked the City for a <br /> solution to the drainage problem. It is unfortunate that . <br /> this situation ever happened, but we must deal with the <br /> matter as it is. There is a problem and an available <br /> solution, but someone needs to pay for it. The City as a <br /> whole is paying the lion's share. <br /> Resident Kurt Lawrence: This project does not qualify as <br /> assessable under the definition of assessable special <br /> assessment. <br /> Property owner George Reiling: Have there been lawsuits <br /> initiated against the developer or the former engineer? I <br /> won't cooperate with the City in this matter until the City <br /> ini tiates lawsuits. <br /> Attorney Filla: There are ways of resolving these types of <br /> issues without going to court. If Mr. Reiling would <br /> cooperate regarding easement acquisition, project costs <br /> would be substantially less. Past agreements indicate that <br /> the properties involved in this matter are properly <br /> assessable. <br /> Resident Michael Giel, 4534 Keithson: It appears mistakes <br /> were made by the City years ago and now the residents are <br /> the "end of the line" when someone needs to pay. I will <br /> fight this assessment and refuse to pay one dime. . <br /> Resident Robert Stennes, 4540 Keithson Drive: I agree with <br /> comments of my neighbors. I don't believe our property can <br /> justifiably be assessed as its drainage does not contribute <br /> and the property does not benefit whatsoever. <br />
