I <br /> feel an assessment in addition to the tree loss is unjust. <br /> Attorney Filla: The appraiser's figures support the <br /> assessment. The appraiser did state that each property may <br /> require individual review, but $1,500 per lot is a <br /> justifiable assessment amount. <br /> Engineer Graham: The City does not have an overall City- <br /> wide storm water utility plan at this time. <br /> Resident George Crimmins, 4509 Keithson Drive: I agree with <br /> my neighbors' comments. where did the City think the water <br /> was going to go? Rather than being assessed, I should be <br /> compensated for my loss of property caused by this <br /> situation. <br /> Attorney Filla: Regarding damages to properties, such <br /> . cl aims are handled as a separate issue, not as a reduction <br /> of assessment. I encourage residents to deal with such <br /> claims through informal discussion with the City before <br /> ini tiating lawsuits. <br /> Resident Kurt Lawrence: We are told we can't be "double <br /> assessed" for one benefit, but that is what is happening <br /> here because the ori gina 1 lot prices paid by the residents <br /> reflected "improved" lots. <br /> Attorney Filla: I disagree with Mr. Lawrence's statement - <br /> property owners have not already paid for the pond <br /> improvement. <br /> Resident Ron Horwath, 4510 Keithson Drive: If everything <br /> was approved by the City before development began, why <br /> wasn't drainage addressed then? <br /> Attorney Filla: In review of the case, we have not found <br /> documentation to support the logic behind what was done <br /> during development, but it was known then that downstream <br /> improvements would be needed. It ~s uncertain why the <br /> anticipated downstream situation was not dealt with then. <br /> Resident Kurt Lawrence: It bothers me that the City <br /> .
