Highway 96 <br /> Arden Hills, MN 55112 <br /> RE: ARDEN PLACE DRAINAGE ISSUE <br /> Dear Council Members: <br /> A public hearing will be held at the June 29, 1992 City Council meeting for the above referenced <br /> project. <br /> Following is a summary of this project thus far. A feasibility study and plans and specifications <br /> were prepared in September 1991 to replace the existing pipe that extends from the low area <br />. behind 1553 Arden Place to the south across Arden Place, and between 1540 and 1548 Arden <br /> Place. Quotes were received for the project. The lowest construction cost estimate received was <br /> for $16,675, which would yield a project cost, based on 25% overhead, of $20,800. I met with <br /> all homeowners who would be affected by construction of this project as originally planned. <br /> The existing pipe does not appear to be contained within an easement. If the City did in fact <br /> o~ginally install the pipe, it may be legally possible to claim a prescriptive easement over the <br /> pipe. <br /> A public hearing was held on October 28, 1991 to discuss the project. There were 8 properties <br /> notified for this hearing, which were those properties that topography maps indicate contribute <br /> storm water runoff. No field topography work was accomplished. The City's Assessment Manual <br /> contains a method of assessing storm sewer improvements by dividing the project cost equally <br /> among the lots contributing runoff. <br /> At the public hearing, a great deal of opposition was heard from many of the notified residents <br /> outside of the two residents with standing water on their property. Comments received included <br /> those who felt the house at 1553 Arden Place should not have been built, the lack of formal <br /> easements over the existing pipe, the quality of the storm water to be directed to Lake Johanna and <br /> the method of payment for the project. <br /> The result of the public hearing was two-fold. We were directed to review th.e possibility of <br /> draining runoff to the east, across Ridgewood Road, to property owned by the Lake Johanna <br /> Beach Club. We also "gain contacted the Rice Creek Watershed District, who verified that runoff <br /> from this small drainage area would have a negligible impact on water quality in Lake Johanna. <br /> The major snowstorm at the end of October 1991 caused any further wok on this matter to be <br />. delayed until 1992. <br /> 1959 SLOAN PLACE, SUITE 200, ST.
