The Subject Property is the site of the Cub Foods <br />grocery store, Cub Pharmacy, and Cub Discount Liquor and is owned by Shannon Square LLC. <br />Adjacent properties to the north, west and south are also zoned B-3, Service Business District, and <br />the parcels to the east are located within the City of Shoreview and are zoned R1, Detached <br />Residential. <br />3. History of the Subject Property <br />In September 2002, the City Council approved a Planned Unit Development (PUD) to construct a <br />90,000 square foot Cub Foods store at the Subject Property. The original PUD was amended in <br />2007 to allow for additional signage and again in 2012 to allow for the construction of a drive -up <br />window for the existing pharmacy located within the building and associated signage. A <br />Conditional Use Permit was also issued for the drive -up window use. <br />Approvals <br />1. Conditional Use Permit <br />On August 28, 2023, the City Council adopted Ordinance 2023-009 to allow the sale of Lower - <br />Potency Hemp Edible Sales which requires a Conditional Use Permit (CUP). Lower -potency <br />hemp edible sales shall be a Conditional Accessory use only permitted in the B-2 General Business, <br />B-3 Service Business, B-4 Retail Business, NB Neighborhood Business and GB Gateway Business <br />Zoning Districts where the principal use is Retail Sales & Service, Restaurant, or Service Station, <br />the business has a liquor or tobacco license issued by the City, and when such accessory use is <br />clearly incidental to the principal use. <br />City Code Section 1355.04 Subd. 3 of the Arden Hills Zoning Code lists the criteria for <br />evaluating a Conditional Use Permit. The Planning Commission and City Council should <br />consider the effect of the proposed use upon the health, safety, convenience and general welfare <br />of the owners and occupants of the surrounding land and the community, in general, including <br />but not limited to the following factors: <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and <br />other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5.
