'Ihe berm was interrled to create privacy f= the units; to help <br /> reduce noise and visibility from the east and southeast (NSP <br /> Sul::station and Highway 10) and the south (Parkshore Drive and I- <br /> 694); and to provide interesting landforms in the backyard. <br /> 2. 'Ihe berm as tuilt, wraps around the east side of the tuilding <br /> instead of gradually sloping all the way to the street in the SE <br /> =rner as was planned and approved. The Planner encourages the <br /> City to allow some form of berm to =ntinue in the SE =rner if it <br /> is determined that the berm should be lowered. <br /> 3. It is questionable as to whether or not the city would have <br /> approved this larger berm if the Awlicant had proposed it <br /> initially. <br /> 4. All residents in the affected units should be =nsulted to <br /> . determine their preference. <br /> 5. 'Ihe berm appears to be located partially in the street Right of <br /> Way f= Old Highway 10 and may have been placed over a City <br /> sanitary sewer line. Construction of the berm in the R/W was not <br /> auth=ized. <br /> 6. 'Ihe "as-tuilt" plan, as attached, does not appear to shOlN the <br /> actual =nfiguration of the berm. <br /> Planner Bergly recommends to delay action f= at least one llIOnth to <br /> allow response fram the residents directly affected. <br /> Probst noted that some affected homeowners were present and asked if <br /> they had any connnents on the berm. Nestor and Edith Korpi stated they <br /> felt the berm should be cut down to 42 inches as they were infonned when <br /> they purchased their horne. Mr". Korpi stated there is going to be a <br /> potential drainage problem as there is only a 10 to 12 inch plastic pipe <br /> used f= drainage. <br /> Joe Juridvich states he likes the high berm because it blocks the NSP <br /> site. Camnission requested the City contact NSP and request screening <br /> and clean up of the site. <br /> winiecki stated the issues need to be resolved with the affected <br /> homeowners and the developer pri= to being turned over to the Townhouse <br /> . Association. <br /> McGraw stated this is not in COllpliance to the =iginal site plan. He <br /> would like a clarification fram the developer when and hOlN they are <br /> going to conform to the =iginal site plan. <br />
