<br />. WHEREAS, the City and the Developer feel that their mutual <br />interests will be served by entering into an agreement <br />relating to the planning, marketing and development of the <br />property within the said tax increment district; <br /> <br /> <br />NOW, THEREFORE, IN CONSIDERATION OF the above stated <br />premises and the mutual covenants hereinafter contained, the <br />City and Developer do hereby agree, as follows: <br /> <br />ARTICLE 1 <br />DEFINITIONS <br /> <br />1.1 Definitions. All capitalized terms used and herein <br />shall have the following meaning unless a different meaning <br />clearly appears from the context: <br /> <br />Aqreement means this Agreement, as may be from time to <br />time modified, amended, or supplemented; <br /> <br />~ means the City of Arden Hills, Minnesota; <br /> <br />Conceot Plans means the concept plans submitted to the <br />city by the Developer, which were prepared by Dovolis, <br />Johnson & Ruggieri, Inc., and are dated May 12, 1993; said <br />. Concept Plans are incorporated herein by this reference; <br /> <br />Countv means Ramsey County, Minnesota; <br /> <br />Develooer means Everest Development, Ltd., a duly <br />organized and existing Minnesota corporation; <br /> <br />Develooment Plans mean the plans, specifications, <br />drawings and related documents of construction work to be <br />performed by the Developer on projects to be developed on <br />the redevelopment property. The plans shall be as detailed <br />as the plans, specifications, drawings and related documents <br />which are submitted to the building department inspector of <br />the City, and shall include at least the following (a) site <br />plan; (b) site grading and drainage plan; (c) foundation <br />plan; (d) floor plan for each floor; (e) cross sections; and <br />(f) elevations; <br /> <br />Develooment District means Development District No.1, <br />which was established by the City pursuant to Resolution <br />No. 89-41 of the City Council; <br /> <br /> <br /> <br /> <br />. <br /> <br />2 <br />
