<br /> . Environmental Law means the Comprehensive Environmental
<br /> Response, Compensation and Liability Act, 42 U.S.C. Sec.
<br /> 96.01 et sea. , the Resource Conservation and Recovery Act,
<br /> 42 U.S.C. sec. 69.01 et sea. , the Hazardous Materials
<br /> Transportation Act, 49 U.S.C. sec. 1802 et sea., the Toxic
<br /> Substances Control Act, 15 U.S.C. sec. 2601 et sea., the
<br /> Federal Water Pollution Control Act, 33 U.S.C. sec. 1251 et
<br /> ~., the Clean Water Act, 33 U.S.C. sec. 1321 et sea., the
<br /> Clean Air Act, 42 U.S.C. sec. 7401 et sea. , the Minnesota
<br /> Environmental Response and Liability Act, Minn. stat. ch.
<br /> 115B, the Minnesota Petroleum Tank Release Cleanup Act,
<br /> Minn. stat. ch. 115C, and any other federal, state, county,
<br /> municipal, local or other statute, law, ordinance or
<br /> regulation which may relate to or deal with human health or
<br /> the environment, all as may be from time to time amended;
<br /> Hazardous Substances means asbestos, ureaformaldehyde,
<br /> polychlorinated biphenyls ("PCBs"), nuclear fuel or
<br /> material, chemical waste, radioactive material, explosives,
<br /> known carcinogens, petroleum products and by-products and
<br /> other dangerous, toxic or hazardous pollutants,
<br /> contaminants, chemicals, materials or substances listed or
<br /> identified in, or regulated by, any Environmental Law;
<br /> Marketina Plan means a plan, to be created by the
<br /> Developer, for the marketing of the redevelopment property
<br /> . for the purpose of developing the same as contemplated
<br /> herein;
<br /> Public ImDrovements mean those public improvements
<br /> which are necessary to support the contemplated development
<br /> and use of the redevelopment property, including without
<br /> limitation, streets and boulevards to satisfy site access
<br /> and circulation requirements, utility improvements and
<br /> extensions to satisfy site utility requirements, and
<br /> appropriate grading and drainage improvements;
<br /> RedeveloDment PrODertv means the real property located
<br /> within Tax Increment District No. 2, established by
<br /> Resolution No. 89-41 of the city Council, and depicted on
<br /> attached Exhibit A;
<br /> State means the State of Minnesota.
<br /> Unavoidable Delavs means extraordinary unavoidable
<br /> delay or delays, outside the control of the parties claiming
<br /> its occurrence, which are the direct result of strikes,
<br /> other labor troubles, unusually severe or prolonged bad
<br /> weather, acts of God, fire or other casualty to the
<br /> improvements, litigation commenced by third parties which,
<br /> .
