<br />. 3.5 Deve10gment Plans. The Developer shall cause <br />Development Plans to be provided to the City, which plans <br />shall be subject to approval by the City as provided in this <br />subsection 3.5. The Development Plans shall provide for the <br />improvements, or phases thereof, to be constructed on the <br />Redevelopment Property and shall be in conformity with the <br />Concept Plan, this Agreement, and all applicable state and <br />local laws and regulations. The City shall approve the <br />Development Plans in writing if: ea) The Development Plans <br />conform to the terms and conditions of this Agreement; <br />(b) the Development Plans conform to the terms and <br />conditions of the Concept Plans; (c) the Development Plans <br />conform to the requirements of the Gateway Business District <br />Ordinance, subject to the modifications thereof set forth in <br />attached Exhibit B; (d) the Development Plans conform to <br />applicable federal and state laws, rules and regulations, <br />and permit requirements; ee) the Development Plans are <br />adequate for the purposes of this Agreement to provide for <br />the construction of the improvements; and (f) no event of <br />default under the terms of this Agreement has occurred. <br />Notwi thstanding subsection e c) above to the contrary, the <br />Developer agrees that any development occurring within the <br />twelve (12) acre parcel located in the middle of the <br />Redevelopment Property, as generally shown on attached <br />Exhibit C, shall be in conformance with the unmodified <br />requirements of the Gateway Business District Zoning <br />. Ordinance, unless the City approves modifications therefrom, <br />based upon Development Plans which are submitted to and <br />approved by the city. <br /> <br />3.6 Regortina. The Developer shall make reports to the <br />City, in such detail and at such times as may be reasonably <br />requested by the city, as to the actual progress of the <br />Developer with respect to the foregoing activities, and <br />shall allow designated representatives of the City, upon a <br />prior notice, to enter upon the Redevelopment Property with <br />the Developer during the construction of improvements to <br />inspect such construction. <br /> <br />ARTICLE IV. <br />CITY COOPERATION, PARTICIPATION AND ASSISTANCE <br /> <br /> <br />The City will cooperate fully with the Developer in order to <br />achieve the development objectives for the Redevelopment <br />Property consistent with the Concept Plan and the terms and <br />conditions of this Agreement. In addition, the City will <br />make tax increment financing assistance available for <br />proposed development. The parties contemplate that a <br />flexible tax increment financing program will be utilized <br />whiCh would permit either "up front" or "pay as you go" tax <br /> <br />. <br /> <br />7 <br />
