<br />. (g) The Developer has not received any notice from any <br />local, state or federal officials that the activities <br />of the Developer with respect to the Redevelopment <br />Property mayor will be in violation of any <br />environmental law or regulation. <br /> <br /> <br />ARTXCLE xxx. <br />PLANNXNG, MARKETXNG, SXTE ASSEMBLY AND DEVELOPMENT <br /> <br /> <br />3.1 PlanninQ. The Developer shall, with the input, <br />participation and approval of the City, undertake and <br />complete comprehensive concept planning for development of <br />the Redevelopment Property, consistent with the Concept <br />Plan. Such planning will include a strategy for site <br />assembly and staging of public improvements. <br /> <br />3.2 Marketinq. The Developer, with the input and approval <br />of the City, will develop an appropriate marketing plan for <br />marketing the Redevelopment Property for the purposes of <br />developing the same as contemplated by this Agreement. Such <br />plan shall include an evaluation of the current and <br />anticipated market for the site, targeting of key prospects <br />or prospect types, and development of methods for <br />. approaching the marketplace and attracting desired users. <br />Such marketing plan shall be provided to the City, and shall <br />be periodically updated. <br /> <br />3.3 site Assemblv. The Developer will develop a strategy <br />for acquisition of various parcels comprising the <br />Redevelopment Property, with the objective of assembling <br />sites suitable for development. The Developer and city <br />recognize that the timing and location of acquisitions will <br />be driven both by market demand and development <br />considerations. <br /> <br />3.4 Develooment. The Developer agrees that it will <br />exercise reasonable efforts to cause the development and <br />construction of improvements on the Redevelopment Property, <br />which improvements shall be constructed in accordance with <br />the Concept Plan and approved Development Plans. The <br />Developer agrees that the scope and scale of the <br />improvements shall not be significantly different than the <br />scope and scale of the improvements shown in the Concept <br />Plan, and as ultimately detailed in Development Plans. The <br />City acknowledges that the Developer'S ability to construct <br />improvements is subject to then current market conditions, <br />including the availability of tenants, owners, and <br />financing. <br /> <br /> <br />. <br /> <br />6 <br /> <br /> <br /> <br /> <br />-------------...-- <br />
