Mayor and City Council <br /> July 12, 1993 <br /> Page 2 <br /> . <br /> To the extent that Mr. Hanson wants to run a sanitary sewer line along the southerly <br /> portion of the Hanson orooertv to connett to existing sanitary sewer improvements located on <br /> .Ilia property, my clients do not object, We understand that the Hanson property has already <br /> been subdivided and platted, and presumably the subdivision approval was given with full <br /> knOWledge by the City and Mr, Hanson that he would have to make the sanitary sewer <br /> hookups on his own property. <br /> To the extent that Mr, Hanson would like this hook-up to occur in the near future so <br /> that he can sell his lots, it is imperative that he do it on his own property. To the extent that <br /> the hook-up is altered to cross-over the Bachman! Andersen property, such hook-ups will be <br /> contested and will delay if not eliminate any proposed improvements on the Bachman <br /> property . <br /> 2. There is no need for the City to incur additional sewer improvements. <br /> ~ The simple fact of the matter is that the Hanson property. the Bachman property, and <br /> the Andersen property all have adequate sanitary sewer improvements to halldIe their existing <br /> lots And even potential or existing subdIvisions thereof. There is no need for the City to <br /> incur additional costs al its expense, or the expense of neighbors. for unneeded and unwanted <br /> improvements. <br /> 3. An)' proposed condemnation for a S81litar)' sewer easement will be opposed <br /> by my clients. <br /> My clients will not agree to a negotiated sale of any easements to the City for the <br /> needless purposes of the proposed sanitary sewer improvements. The acquisition of any such <br /> easementS would, therefore. have to take place by condemnation, and my clients intend to <br /> contest any such proceeding and argue that the improvements fail to have any "public <br /> pUlpose" . <br /> 4. The sanitary sewer improvements could end up costing the City of Arden <br /> Hills tens of thousands "of dollars. <br /> Although we have not yet obtained a copy of the feasibility study. we reviewed it <br /> quickly last Friday. Our reading of that feasibility study indicates that the total cost of <br /> improvements could well be in excess of $50,000. not merely the $8,000 as set forth in the <br /> .
