CITY OF ARDEN HILLS <br /> MEXm\NOOM <br /> TO: Dorothy Person <br /> FRCH: Brian Frits~ <br /> D1l.TE: September 10, 1993 <br /> stJBJECT: Transient Merchants <br /> As you requested, we have completed a survey of neighboring communities on <br /> their transient merchants ordinance. Included in this survey were Mounds <br /> View, New Brighton, Roseville, Shoreview, White Bear take and Vadnais Heights. <br /> For the most part, each of these communi ties has an ordinance which allows <br /> transient merchants/peddlers to sell their wares. However, it is clear that <br /> each city has their 0lI/l1 approach for resporxting to these requests. <br /> 'lhe only CCIllUTIOn section of each community's ordinance was in allowing <br /> residents of the state to sell fruits, vegetables, dressed meats or other farm <br /> products . This is in a=rdance with Minnesota State Statute 329.08, which <br /> states that persons may sell or peddle the products of the farm or garden <br /> occupied and cultivated by themselves. A number of the cities did place <br /> restrictions on location and safety. <br /> . 'lhe response to requests from non-profit/for profit organizations was varied. <br /> Same communities do not recognize any differences between the two types, <br /> others do not allow for-profit requests at all. The most interesting <br /> approach was in White Bear take. 'lhey require both profit and non-profit <br /> groups to wear an identification sticker issued by the City. Two different <br /> types of stickers are used which make it clear to a resident which type of <br /> organization the peddler represents. 'lhe key is to keep the residents <br /> intorned of their rights. <br /> 'lhe last activity that we fourxl. to be of some benefit is the completion of a <br /> crllninal background check. A number of the cities with their 0lI/l1 police <br /> deparbnent require this criminal check before any permit can be issued. In a <br /> number of occasions, these communities have denied or revoked a permit due to <br /> past criminal activity. This check has deterred same applicants from <br /> proceeding with the request. <br /> A number of the cities also have a small fee required with the permit. <br /> Similar to the criminal check, this has proved a deterrent in some cases. <br /> Of the cities we =ntacted, Shoreview, Mounds view and White Bear Lake clearly <br /> had ordinances which would address the issues/=ncerns of Arden Hills. <br /> Regardless of the ordinance adopted by the City, we should consider placing an <br /> article in the Newsletter which explains the rights of a homeowner in <br /> responding to peddler/transient merchants. Staff will also be working on the <br /> . development of a more detailed set of procedures to outline the process for <br /> reviewing these requests. <br />
