Th:is Agreement dated the day of <br /> -' 1993 :is entered into by and between Ronald Bongard and <br /> Patricia Bongard (hereinafter "Bongardff) , Dale H. Noyed and <br /> Nancy Noyed (here1nafter "Hayed"), Walter Bauer (hereinaEter <br /> "Bauer") and the City of Arden Hills, a political subdivision <br /> and municipal corporat:ion oE the state of Minnesota <br /> (hereinafter "City"). <br /> 2. Recitals. <br /> 2.1 Bongard represents that they are the fee owners of <br /> property located at 1553 Arden Place which is legally <br /> described as follows (hereinafter "Bongard Property"): <br /> The easterly 95 feet of Lots 14, 15, and 16, <br /> Block 1, Arden Hills. <br /> 2.2 Noyed represents that he is the fee owner of property <br /> located at 3505 Ridgewood Road which is legally described <br /> as follows (hereinafter "Noyed Property"): <br /> Lots 11 and 12, Block 1, Arden Hills. <br /> . 2.3 Bongard and Noyed have requested that the City allow the <br /> construction of a storm sewer improvement project <br /> (hereinafter "Improvement project") which upon completion <br /> would be accepted by the City for maintenance as part of <br /> the City's sto= water collection system and which <br /> Improvement Project is generally described as follows: <br /> a. Identification of a storm sewer improvement <br /> easement area on portions of the Bongard and Noyed <br /> Property as required by the City's consulting <br /> engineer (hereinafter respectively the "Bongard <br /> Easement" and "Noyed Easement"). <br /> b. Identification of storm sewer improvement easement <br /> areas on a portion of property owned by Raymond E. <br /> JohnSon located at 1548 Arden Place (hereinafter <br /> the "Johnson property") which property is legally <br /> described as follOWS: <br /> Lot 29, Block 2, Arden Hills. <br /> and the conveyance of such easement area to the <br /> City at no cost on forms approved the City's <br /> attorney subject to the following conditions: <br /> . 1. Approval of Improvement Project by Rice <br /> Creek Watershed District. <br /> ---- <br />
