Storm sewer main to be located <br /> . underground on the Johnson Property <br /> provided that manholes, as required by <br /> the City's consulting engineer, may be <br /> located at surface level of the Johnson <br /> property. <br /> 3. Two trees currently located within the <br /> easement area shall be removed at the <br /> cost of the City. <br /> 4. The City shall maintain the outlet of a <br /> storm water pipe on the Johnson property <br /> so as to remove any drainage silt that <br /> may be deposited from the storm water <br /> pipe into the channel water course <br /> adjacent to the Johnson Property. <br /> 5. The project shall be constructed at no <br /> cost to Johnson and the City shall save <br /> Johnson harmless from the payment of any <br /> and all costs or assessments related to <br /> the Improvement Project. <br /> c. Identification and acquisition of additional storm <br /> sewer improvement easements from Mr. and Mrs. <br /> . Lundgren and Mr. and Mrs. Lis at no cost to the <br /> City. <br /> d. The construction of the Improvement project within <br /> the easQment area pursuant to plans and <br /> spec:if:icatlons approved by the City's consulting <br /> engineer which are attached as Exhibit A <br /> (hereinafter "Approved Plans and Specifications"). <br /> 3. Bongard and Noyed have received a quote from the Plymouth <br /> Plumbing Company (hereinafter "Contractor") which indicates <br /> that the Improvement Project can be constructed according to <br /> the Approved Plans and Specifications for the estimated cost <br /> -of $14,000.00. <br /> 4. In reliance upon the above representations and in <br /> consideration of the mutual undertakings herein expressed, the <br /> parties agree as follows: <br /> 4.1 Cqnstruction Contract.. <br /> Bongard and Noyed agree to contract with the contractor <br /> for the construction of the Improvement projeot. The <br /> Contractor shall provide proof of liability insurance, a <br /> performance bond and a payment bond in a form acceptable <br /> to the City's attorney. <br /> . 2 <br /> ~-- <br />
