Storm sewer main to be located . underground on the Johnson Property provided that manholes, as required by the City's consulting engineer, may be located at surface level of the Johnson property. 3. Two trees currently located within the easement area shall be removed at the cost of the City. 4. The City shall maintain the outlet of a storm water pipe on the Johnson property so as to remove any drainage silt that may be deposited from the storm water pipe into the channel water course adjacent to the Johnson Property. 5. The project shall be constructed at no cost to Johnson and the City shall save Johnson harmless from the payment of any and all costs or assessments related to the Improvement Project. c. Identification and acquisition of additional storm sewer improvement easements from Mr. and Mrs. . Lundgren and Mr. and Mrs. Lis at no cost to the City. d. The construction of the Improvement project within the easQment area pursuant to plans and spec:if:icatlons approved by the City's consulting engineer which are attached as Exhibit A (hereinafter "Approved Plans and Specifications"). 3. Bongard and Noyed have received a quote from the Plymouth Plumbing Company (hereinafter "Contractor") which indicates that the Improvement Project can be constructed according to the Approved Plans and Specifications for the estimated cost -of $14,000.00. 4. In reliance upon the above representations and in consideration of the mutual undertakings herein expressed, the parties agree as follows: 4.1 Cqnstruction Contract.. Bongard and Noyed agree to contract with the contractor for the construction of the Improvement projeot. The Contractor shall provide proof of liability insurance, a performance bond and a payment bond in a form acceptable to the City's attorney. . 2 ~--
