Chair winiecki explained that the applicants, stephen & Christine <br /> Anderson have forwarded a letter to the city and the Commission <br /> requesting that their application be withdrawn. As a courtesy to anyone <br /> present waiting for this case to be heard, it was announced that the <br /> application has been withdrawn. <br /> Cl\SE #93-25: V1\CM'IClN OF EMEMENr. 3945 ROI.LIN:; HILLS RCllID. .nums mINl'CIl. <br /> Chair Winiecki explained that the applicant is requesting to vacate a <br /> twenty foot wide "utility easement" . <br /> Mr. Fritsinger referred to his report dated October 19, 1993, and <br /> highlighted both the background and findings su=ounding this request. <br /> (If needed, refer to your Planning Packet report, Case #93-25). <br /> Chair Winiecki asked the applicant if he had anything to add to this <br /> report. Mr. Hanton stated that during the closing process of this new <br /> home, it was discovered that a plat from 1957 reflected this utility <br /> easement running north and south across the new lot, right through his <br /> living room. Further investigation by the City staff and attorney found <br /> no record of this easement other than on attachment "A". Because of the <br /> topography of the lot and the setback requirement mandated by the City <br /> at the ti1ne of the lot split, there was no other way to set the home on <br /> this lot. <br />. <br /> ----- <br />
