As Mr. Lis has decided he is not interested in havin:j the pipe <br /> installed on his property, a new easement and drainage agreement will <br /> need to be signed by Mr. Johnson. Mr. Johnson is =ently reviewing <br /> the new agreement and the City is expectin:j the signed agreement before <br /> the December 13 Council meetin:j. The Johnson property will =eate a <br /> very naITOW easement for installation of this pipe. On Friday, December <br /> 10, the neighbor Bill Kaplan, 1556 Arden Place verbally advised the City <br /> that he does not want this additional water flowin:j into the lake. He <br /> further believes the pipe is too low and is bein:j kp..UJ:""Cly placed. <br /> . Mr. Kaplan was advised by staff that the City has secured all proper <br /> approvals. Mr. Kaplan indicated he will stop this project in court. <br /> The city has advised the private property owners and project holders <br /> (Bongard & Noyed) of this charge. The Engineer is reverifyin:j with the <br /> DNR and Rice Creek Watershed District that proper approvals have been <br /> given. Prior to this change it had been anticipated that the project <br /> would begin today, Friday, December 10. <br /> Approve Resolution #93-62, recognizin:j new arrangement and rescirrling <br /> resolution #93-46 which previously approved the project under state <br /> statute. <br /> III. Consent Calendar items: <br /> a. The calendar f= 1994 is based on =ent schedules, including the <br /> worksession on the 3rd Thursday of each month. O1anges can be <br /> ll'ade durin:j the year for unexpected issues. The January 3, 1994 <br /> special meetin:j could incorporate issues scheduled for the January <br /> 10 meeting, therefore eliminatin:j the January 10 meetin:j to avoid <br /> four (4) meetings in the month of January. <br /> b. Resolution #93-66, This resolution is needed to apply for "Tree <br /> City" status recognizing the 1993 application and the city's <br /> beautification program. <br /> c.
