This property is owned by Arrerican oil Cl.:XIpany and <br /> leased to the applicant. The applicant has recently acquired the .forrrer <br /> . Great Lakes Restaurant, 1310 County Road E, and is proposing to convert <br /> the use into an 8 bay Arroco C'erticare. The two existing service bays in <br /> the existing Arroco station will be converted to convenience store use <br /> and the third bay into storage. <br /> The proposed building is l=ated within a B-2, General Business <br /> District. Service stations are allowed only by SUP in this district. <br /> No gas or fuels will be dispensed from this site, onlyautarobile repair <br /> is proposed. Physically, the change will involve raising the =f <br /> several feet and rebuilding much of ~the interior. However, the <br /> fcotprint of the building will remain unchanged. <br /> The existing building and site plan was revie~ and approved as part of <br /> Case #74-15. The site plan was approved subject to T.H. #51 being <br /> considered the front yard. It appears that a "waiver" or variance was <br /> granted for the setbacks; however, it is unclear in the minutes as the <br /> specific "waiver". <br /> The building is a non-conforming building because of the existing <br /> setbacks. Under section IX, A, 2 of the ordinance a non-conforming <br /> building rray exist so long as it is used for the purposes pennitted in <br /> the zoning district in which it is l=ated. Because the incmpatibility <br /> . is rrerely technical in nature it shall be exempt fran the provisions of <br /> Section IX. In other words, this non-conforming use can continue. <br /> ----.-- <br />
