BACKGROOND The applicant currently operates an Arroco Service Station and carwash at 1306 County Road E. This property is owned by Arrerican oil Cl.:XIpany and leased to the applicant. The applicant has recently acquired the .forrrer . Great Lakes Restaurant, 1310 County Road E, and is proposing to convert the use into an 8 bay Arroco C'erticare. The two existing service bays in the existing Arroco station will be converted to convenience store use and the third bay into storage. The proposed building is l=ated within a B-2, General Business District. Service stations are allowed only by SUP in this district. No gas or fuels will be dispensed from this site, onlyautarobile repair is proposed. Physically, the change will involve raising the =f several feet and rebuilding much of ~the interior. However, the fcotprint of the building will remain unchanged. The existing building and site plan was revie~ and approved as part of Case #74-15. The site plan was approved subject to T.H. #51 being considered the front yard. It appears that a "waiver" or variance was granted for the setbacks; however, it is unclear in the minutes as the specific "waiver". The building is a non-conforming building because of the existing setbacks. Under section IX, A, 2 of the ordinance a non-conforming building rray exist so long as it is used for the purposes pennitted in the zoning district in which it is l=ated. Because the incmpatibility . is rrerely technical in nature it shall be exempt fran the provisions of Section IX. In other words, this non-conforming use can continue. ----.--
