Highway 96 <br />Arden Hills, MN 55112 <br /> <br />Hand-Delivered <br /> <br /> <br />Re: 1994 Pavement Management Improvement <br />PIN Number 34-30~23-13-0008 <br /> <br />Dear Ms. Person: <br /> <br />Please consider this letter as notice that the undersigned <br />owners of the property located at 1301 Cannon Avenue, object to and <br />. intend to appeal our assessment of $4,838.00 in connection with the <br />proposed road improvement to Dunlap Street North scheduled for <br />summer of 1994. This letter is intended to satisfy the <br />requirements of Minnesota statutes S 429.081 as to filing a written <br />objection with the city administrator to protect our appeal rights. <br /> <br />We object to the assessment for the following reasons: <br /> <br />1. The proposed "improvement" does not benefit our property. <br />We believe that the proposed improvement will actually detract <br />from the value of our property. <br /> <br />2. Although we were assessed for 164 feet of "frontage", only <br />a portion of this assessed frontage actually abuts the <br />proposed "improvement". The remaining footage abuts a road <br />that is unimproved and is not intended to be improved in the <br />proposed assessment or in the future. The Assessment Manual <br />adopted by the city of Arden Hills states that, because our <br />lot is platted, our frontage assessment is to be measure along <br />the property line "abuttina the improvement". The most our <br />property may be assessed is for that which abuts the <br />improvement. Any argument that this assessment may be based <br />on usage is arbitrary and capricious, is not warranted by <br />actual usage and is also not authorized in the Assessment <br />Manual. <br /> <br /> <br />. <br /> <br /> <br /> <br /> <br /> <br />---.......--.. _.~.~ . . ._-_.~-- <br />
