I have w::>rked with the attorney, Dan Winkel <br /> and Cindy Severtson to address the drainage and park ll'aintenance <br /> issues identified at the last Planning Ccmnission rreeting. <br /> By w::>rking with M. Filla and in reviewing the existing case files, the <br /> following information ll'aY clear up sore of the questions :raised at <br /> that meeting, <br /> L The City is responsible for the rraintenance of the recreation <br /> . park area. This does not include the swinming pool, tot lots or <br /> parking area, <br /> 2. The City has never taken responsibility f= the <br /> storTIMater/drainage in the park nor is it responsible to <br /> maintain the stOrmNater runoff. <br /> 3. Section 14-59 of rmmicipal code addressed recreational areas in <br /> rrobile hane parks. OUr attorney has clarified this in stating <br /> that as long as the swimning pool is required as part of the <br /> SUP, the swinrning pool llUlSt be rraintained for the tenants use. <br /> 4. The attorney went further to state that Section 14-59 does not <br /> require the swimning pool to operate forever and the City does <br /> have the ability to amend the SUP to rerrove the swirrming pool <br /> requirements. <br /> BF:to <br /> . <br />
