VolodyrrrJr & Olga <br /> Ukrainian Orthodox Church has been submitted for review as part of tbe <br /> September 9, 1994 Planning Coll1nission meeting. During the <br /> discussions staff had witb the applicant, a ooncern was raised about <br /> the applicability of public use dedications for this project. <br /> Staff has reviewed Section 22-9, Public Use Dedications, of the Code <br /> of Ordinances for the City of Arden Hills. I have also attached a <br /> copy of this for your review. <br />. The applicant indicated that for a number of reasons this dedication <br /> is not appropriate for this proj ect . After reviewing this with the <br /> City Attorney and previous case files, staff =uld recomnend that in <br /> this case the public use dedication should be applied. Mr. Filla did <br /> state, however, that the City has apparently negotiated tbese <br /> percentages in the past. Because of this, the City is not required <br /> \ffider this ordinance to receive the full dedications as noted. <br /> The ordinance specifically states that the developnent of property <br /> within the City will place a greater clerrand on tbe City's right to <br /> acquire land for parks, playgrounds, trails, wetlands or open space if <br /> the City's physical environment is to be preserved and enhanced. The <br /> ordinance does not specifically detail the requirements for a church <br /> or a non-profit organization. The ordinance sirrpl y states that the <br /> percentage of dedication for non-residential projects shall not exceed <br /> ten (10) percent. <br /> In this case, it is obvious that the dedication of land =uld not be <br /> appropriate. In lieu of land dedication, tbe developer may pay to the <br /> City an arr'O\ffit of cash equal to the percentage of land required to be <br />. dedicated. This arrount is to be based upon the fair market value of <br />
