The Church dedicated 4.57 acres <br /> of land for park development which included three plus acres of park <br /> and plus one acre of pond. If these same standards were applied to <br /> the current application, a fee of $17,570 or .48 acre =uld be <br /> appropriate. <br /> As another carparison, Cottage Lifestyles, which is developing a 60 <br /> unit apartment cextplex on a 4.43 acre parcel is only paying the City <br /> $19,6000. This developnent requires and places a greater burden on <br /> the City infrastructure than the proposed church. However, the public <br /> use dedication ordinance only discusses the demand on open space not <br /> the demand on infrastructure. <br /> As I stated earlier, the applicant has expressed c=erns about being <br /> required to tmdertake public use dedication. They have cited recent <br />. SUpreme Court decisions, non-profit status, and tax-exempt status as <br /> reasons for supporting the Church's position on tbe dedication <br /> requirements. <br /> By ordinance, the City Council must review and approve all public use <br /> dedication. The SUP for the church requires that the park dedication <br /> be resolved prior to tbe issuance of a building permit. Staff =uld <br /> like to resolve this as soon as possible. Staff =uld like the City <br /> Co\fficil to consider this issue further and provide any ccmrents it may <br /> have to staff at the =rksession meeting.
