. .
. CITY OF ARDEN HILIS
MEM:lRlINIJ[]M
DATE: September/6, 1994
ro: Dorothy Person. City Administrator
FRCM: Brian Fritsinger, CamIlm.ity Planning Coordinae@
stJBJECl' : Park Dedication for Planning Case #94-22
An application for Site Plan Review and SUP for Sts. Volodymyr & Olga
Ukrainian Orthodox Church has been suJ::xnitted for review as part of the
September 9, 1994 Planning Comnission meeting. Wring the
discussions staff had with the applicant, a concern was raised about
the applicability of public use dedications for this project.
Staff has reviewed Section 22-9, Public Use Dedications, of the Code
of Ordinances for the City of Arden Hills. I have also attached a
copy of this for your review.
. The applicant indicated that for a number of reasons this dedication
is not appropriate for this project. After reviewing this with the
City Attorney and previous case files, staff would recomrend that in
this case the public use dedication should be applied. Mr. Filla did
state, however, that the City has apparently negotiated these
percentages in the past. Because of this, the City is not recr.llred
under this ordinance to receive the full dedications as noted.
The ordinance specifically states that the developrent of property
within the City will place a greater demand on the City'S right to
acquire land for parks, playgrounds, trails, wetlands or open space if
the City's physical envirorurent is to be preserved and enhanced. The
ordinance does not specifically detail the recr.llrerrents for a church
or a non-profit organization. The ordinance simply states that the
percentage of dedication for non-residential projects shall not exceed
ten (10) percent.
In this case, it is obvious that the dedication of land =uld not be
appropriate, In lieu of land dedication, the developer rray pay to the
City an arrount of cash equal to the percentage of land recr.llred to be
dedicated. This arrount is to be based upon the fair rrarket value of
.
