The Church dedicated 4.57 acres of land for park developrent which included three plus acres of park and plus one acre of pond, If these sarre standards were applied to the current application, a fee of $17,570 or ,48 acre v.ould be appropriate. As another ccrrparison, Cottage Lifestyles, which is developing a 60 unit apartment complex on a 4.43 acre parcel is only paying the City $19,6000. This developrent requires and places a greater burden on the City infrastructure than the proposed church. However, the public use dedication ordinance only discusses the demand on open space not the demand on infrastructure. As I stated earlier, the applicant has expressed concerns about being required to undertake public use dedication. They have cited recent . Supreme Court decisions, non-profit status, and tax-exempt status as reasons for supporting the Church's position on the dedication requirements. By ordinance, the City Council rwst review and approve all public use dedication, The SUP for the church requires that the park dedication be resolved prior to the issuance of a building permit, Staff would like to resolve this as soon as possible.
