Wilson <br /> Executive Director <br /> SUBJECT: October Report <br /> Preparation for the upcoming state legislative session began in <br /> earnest in October. Mayor Bob Benke and City Manager Matt Fulton, Ann Higgins <br /> from the League of Minnesota Cities, and I met with Senator Steve Novak on <br /> October 7 to share our concerns/issues and to seek his advice on strategy. He <br /> was very supportive and helpful, but we wiil need to continued to keep him <br /> apprised of our efforts. <br /> . Greg Moore, Executive Director of the Northwest Cable Commission, <br /> and I met with Tom Creighton and Adrian Herbst and their assistants on October <br /> 11 to get them started on the process of developing legislation, at a cost not to <br /> exceed $15,000. The first phase wiil involve researching state statutes to <br /> identify all relevant telephone and cable regulations, determine when different <br /> rules apply to essentially the same type of telecommunications service, and try to <br /> resolve those differents. In addition, they will identify statutes that grant or <br /> proscribe municipal authority in these areas. <br /> The second phase will consist of drafting a model right-of-way <br /> ordinance or ordinances and legislation to amend existing statutory provisions, as <br /> necessary, to protect and/or extend municipal authority over the rights-of-way. <br /> Ann Higgins has scheduled additional meetings with the two attorneys on <br /> November 11 and November 18 to review their progress. <br /> A small group of us ( including Higgins, Creighton, Herbst, and <br /> Moore) met with representatives of the Minnesota Cable Communications <br /> Association on October 14 to discuss our interests and to determine where they <br /> might overlap. We also have plans to meet with representatives of U.S. West <br /> (Nov. 11) and with staff at the Public Utilities Commission (to be scheduled). <br /> . <br /> - -.--..- <br />
