Bethel Colleoe Surface Water Mana9""'""nt (SWM) W""l <br /> As per ordinance requirements, this utility custarer has <br /> registered a fornal appeal on the arrount they are billed. 'Ihis <br /> appeal consists of four primary concerns. The City Engineer's <br /> review of these issues has resulted in a reccmrended dismissal <br /> of three of them and agreement with one (Valentine lake surface <br /> exerrption) . The financial irrpact of the City Engineer's <br /> reccmrendation v.o.lld be an approxirrate decrease in annual SWM <br /> fund revenues of $11,775 (6% of the total) . Staff :recorrnends <br /> the partial approval of the appeal ccmrencing with the fourth <br /> quarter 1994 (10/1/94 - 12/31/94) utility billings with action <br /> consisting of exerrpting the 58 acres representing Lake Valentine <br /> from the SWM fee. <br />A-2. MSI Insurance SWM Anl:Je!al <br /> 'Ihis is another fornal appeal of SWM fees consistent with the <br /> process defined by ordinance. The utility custarer contends <br /> that runoff on the property is retained on-site. The City <br /> Engineer's review of this appeal draws a distinction between . <br /> runoff beillg "detained" versus "retained" and reo::mrends denial <br /> of the appeal. <br />B, ResollltiC'll1 94-64 Cotlnt~ R=n F 'T)rrnhor-k iran Ramsey C'Dllntv <br /> 'Ihe City has had nurrerous discussions in 1994 with Ramsey County <br /> conceming various tUlllback issues. The County Road F tUlllback <br /> plan was discussed with the Council at a previous Sl.lllnter 1/oOrk <br /> session, QJange items since then have been a legal b:Ju:ndary <br /> 1/oOrking definition understanding with the City of New Brighton <br /> and an increase in the County rating of the road which has <br /> resulted in a lower funding level (96,5% versus the earlier 100% <br /> estirrete) . Staff recarrnends the adoption of this resolution to <br /> initiate the tUlllback process. <br />C.
