WHEREAS, at the hearing on May 13, 2024, the City Council ordered a hearing on the Assessment and the Deferred Assessment, which shall occur on Tuesday, May 28, 2024, at 7:00 p.m., or as soon thereafter as is possible; and WHEREAS, at the hearing ordered to occur on May 28, 2024, the City Council may adopt the final assessment roll for the Assessment and the Deferred Assessment, and determine the interest rate applicable to the Deferred Assessment; and WHEREAS, the City Clerk has notified the City Council that such proposed assessment for the Improvement has been completed and filed at City Hall for public inspection. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS: 1. The portion of the cost of the Improvement to be paid by the City is hereby declared to be $2,124,615.05 The portion of the cost to be assessed against benefited property owners is declared to be $718,176. 2. All assessments for the Improvement shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with property taxes for the year 2024, and shall bear an interest rate to be determined from date of the adoption of the assessment resolution. The City Clerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for the Improvement against the property located at 1370 Colleen Avenue, without regard to cash valuation, as provided by law, and shall file a copy of such proposed assessment in her office for public inspection; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF ARDEN HILLS, MINNESOTA: 1. A hearing shall be held on May 28, 2024, in the Council Chambers at 7:00 p.m. or as soon thereafter as is possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by the Improvement will be given an opportunity to be heard with reference to such assessment, including the Assessment and the Deferred Assessment for 1370 Colleen Avenue. 2. Publication by the City Clerk is hereby directed to cause notice of the hearing on the proposed Assessment and Deferred Assessment once in the official newspaper at least two weeks prior to the hearing, stating in the notice the total cost of the Improvement is hereby approved. Notice shall be mailed to the owner of 1370 Colleen Avenue not less than two weeks prior to the hearings is also approved. The owner of 1370 Colleen Avenue may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the Assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the City the entire amount of the Assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made.
