Walsh, Parks and Recreation Director C5J <br />I SUBJECT: Data Privacy Issues with regards to Credit Card and <br /> Telephone Registration <br />I As you are aware. the former City Administrator and I had several conversations regarding the <br /> possibility of implementing telephone registration and payment for services using credit cards. <br />I Aside from the logistical questions with regards to installing an additional phone line, and <br /> possible added staff time to process the information there is a cost factor associated with paying <br /> the user fee. I do feel that the City of Arden Hills should pursue this option regardless of these <br />I concerns, However. the Millllesota Government Data Privacv Act, which went into affect <br /> . , <br /> August I, 1994, presents a legal barrier to implementing telephone registration. <br />I- The legislature added new information to Section 13.57 (Social Recreational Data). The <br /> following is the exact wording of the section with the new subdivision underlined, <br />I The following data collected and maintained by political subdivisions for the purpose of <br /> enrolling individuals in recreational and other social programs are classified as private, <br />I pursuant to Section 13.02, Subdivision 12: the name, address, telephone number. anv <br /> other data that identifies the individual. and anv data which describes the health or <br /> medical condition of the individual, family relationships and living arrangements of an <br />I individual or which are opinions as to the emotional makeup or behavior of an individual. <br /> Information we receive from each participant is now considered private. Section 13,04, rights of <br />I subjects of data, covers how this data can be collected and used. In summary, each <br /> participant/guardian must sign a tellllessen warning and waiver for the City to use participant <br /> information for program use. Therefore, registrations should not be taken over phone since a <br />I written release is not obtained. <br /> I am working with a committ~e to modify the Data Privacy Legislation so that cities are able to <br />I use participant information for program use without having participants sign a waiver. I will <br /> keep you updated. My recommendation is to hold off on any further phone registration process <br />I until the data privacy issue is worked out. <br />I- CS \VOjr <br />I <br />
