I <br /> A resident briefly interrupted the chair and inquired as to the process this application takes. <br /> Chair Erickson indicated the Planning Commission is merely an advisory board to the City I <br /> Council, and will make a recommendation to the City Council for their review. The Planning I <br /> Commission reviews applications and applies City Ordinances to the application, and makes <br /> recommendations based on the ordinances. <br /> A resident indicated the Council would not have to follow a recommendation given to them by I <br /> the Commission. Chair Erickson indicated this to be correct. <br /> Mr. Fritsinger indicated the Planning Commission holds the Public Hearings regarding I <br /> applications, there will not be another Public Hearing on this item at the Council meeting, <br /> although residents can ask to comment on the project at Council meetings. I <br /> Mr. Fritsinger responding to the inquiry regarding Bethel College open space requirement, he -I <br /> indicated this parcel of land was not included in the total lot, for lot coverage requirements; also <br /> the lO acre site to the south was not included in the requirement and is therefore available for <br /> development. <br /> A resident inquired if it is the responsibility of the City to stand by statements of the realtors who I <br /> stated this area was never to be developed, because it was Ramsey County open space, the I <br /> comments were based on information the City provided to the realtors. City Anorney Filla <br /> indicated the City has no control over what is stated in a housing agreement, the zoning of the <br /> area is denoted as R-l, the zoning would take precedent over errors in the Comprehensive Plan. I <br /> City Attorney indicated the propeny is zoned R-l, the Zoning Ordinance states the following <br /> uses are allowed, the Single Family an ached, Single Family detached (the most popular), Single I <br /> Family under density zoning (what is being proposed) and Two Family dwelling. Some of the <br /> uses require building permits, special use permits, this development requires a Planned Use <br /> Development. I <br /> Chair Erickson noted the option that best serves the desire to keep as much open space as <br /> possible, would be this proposed use as a Planned Unit Development. I <br /> A resident inquired if there was clear title to the land. Mr. Ogren indicated he has a Purchase <br /> Agreement with Bethel College and they are obligated to close.
