1-. ---, ~....."
L.. _. '".-' il

I. Arden 1j:jlls I?lannim~ Minutes Faile 11 03/01/95

I Commissioner Larson inquired if staff is comfortable with the proposal that the developer has
made, in regards to the recommendations of Mr. Stonehouse. Mr. Fritsinger indicated there are
I minor issues, but staff feel they can be resolved.

I There were brief interruptions and discussions among the audience.

City Attorney Filla indicated if there are items that concern the Commission, the developer
I should be asked to provide answers. He indicated if these items do not affect the decision of
recommendation, the items should be passed on to the City Council as stated conditions to the
approval.

I Comments from the audience indicated the City should purchase the land and leave it as open
space, using Public Land Use Trust monies. Mr. Fritsinger indicated those monies are available
I for use only as a loan, and the City would have to buy it from them, resulting in a cost to the
residents.

I Piotrowski moved, Larson seconded a motion to table application #95-12, until additional
information is obtained.

._ Mr. Ogren indicated if there are concerns regarding the garage, it could be removed. He noted
after walking the trail with Parks and Recreations Director Cindy Walsh, they agreed, if the
walking path is moved, more trees and brush will have to be moved, although he would be
I willing to do that also. He stated any conditions the Planning Commission feel are appropriate
would be followed by the applicant.

I Chair Erickson inquired if perhaps modifications could be made rather than tabling the item. Mr.
Fritsinger indicated the City may only retain an application for 60 days.

I Mr. Ogren inquired if he would develop Single Family detached homes, could an application of
preliminary and final plat be made at the same time. Mr. Fritsinger indicated after review, it
I would be possible to have the preliminary and final plat at the same time.

Rye inquired if this area was noted originally as open space, and what were the intentions of
I Bethel College for this land. Mr. Fritsinger indicated his only reference is after talking with an
individual from Bethel College who has been there for 20 years, that indicated the land was not
assumed co be open space forever. Mr. Fritsinger indicated there is no documentation available
I to staff which supports the identification of the site.

I Upon roll call vote Commissioners Piotrowski, Larson and Carlson voted in favor;
Commissioners Rye, Nelson, and Erickson voted against. The motion failed.

I-
I

---------
