,
'. 2
I (4) The RGU responds to the comments received and makes a decision on the
need for an EIS based on the EA W, comments received and the responses
I to the comments. The RGU and other units of government may require
modifications to the project to mitigate environmental impacts as disclosed
through the EA W process.
I When is an EA W Required?
I An EA W is required for any project listed in the "mandatory EA W categories" of the EQB
rules. It is staffs' position that this project does not fall under any ofthese categories and a
, mandatory EA W is not required.
Ifthe preparation of an EA W is neither mandatory nor exempted the City has the option to
, prepare an EA W. The City may elect this option if it finds that available evidence indicates
that the project "may have the potential for significant environmental effects."
, Who Prepares the EA Wand Who Pays for Its Costs?
,. The proposer of the project provides the required data or information to the City. It is the
RGU (City of Arden Hills) duty to complete the EA W form.
The cost ofthe EA W will be borne by the developer. The City requires the developer to pay
I all associated fees incurred by the City or its consultants as it relates to a project.
Staff Recommendation
, In reviewing the Petition and the issues yet to be resolved on this project, the completion of
I an EA W presents an opportunity to take a closer look at the site and to better provide more
detailed information about the potential environmental impacts which will assist in the
analysis of the project.
, Staff would recommend the Council consider a motion directing Staff to hire a firm to
complete the EA W for the proposed townhome project.
I
I
I
,.
I
