RE: Park Property on Old Snelling Ave. at Ridgewoud Rd. & Lindey's Triangle . Background . At the City Council's request Attorney Filla has researched the City park properties known as Lindy's Triangle and the parcel of property between Old Snelling and Ridgewood Rd. He has sent the City Abstracts of Title for these properties. . Prunertv Limitatiuns Old Snelling and Ridgewood Rd. Prupertv Attorney Filla believes the fee title to this property was in the name of John J. Kenna, Jr. It .- appears to have two limitations: 1. The entire area is subject to a roadway easement in favor of the City of Arden Hills. . 2. The fee owner used this area to fulfill the City's park dedication requirements even though this does not appear on the Abstract of Title. . Lindy's Park Again, Attorney Filla believes that the fee title to this area was in the name of John J. Kenna, Jr., . subject to the two following limitations: 1. The City of Arden Hills condemned the right use of this parcel as a public park and open . space. The City has the right to use this property for a park; however, the fee owner is John J. Kenna, Jr. . 2. The portion of the southwest comer (100 ft.) is still subject to a Ramsey County road easement if the City chooses to vacate the area for park purposes. . Conclusion Attorney Filla concludes that the City of Arden Hills does not have the right to convey either parcels of property for development purposes.
