FROM: Cindy Walsh, Parks & Recreation Director c? <br /> . RE: Park Property on Old Snelling Ave. at Ridgewoud Rd. & Lindey's Triangle <br /> . Background <br /> . At the City Council's request Attorney Filla has researched the City park properties known as <br /> Lindy's Triangle and the parcel of property between Old Snelling and Ridgewood Rd. He has <br /> sent the City Abstracts of Title for these properties. <br /> . Prunertv Limitatiuns Old Snelling and Ridgewood Rd. Prupertv <br /> Attorney Filla believes the fee title to this property was in the name of John J. Kenna, Jr. It <br /> .- appears to have two limitations: <br /> 1. The entire area is subject to a roadway easement in favor of the City of Arden Hills. <br /> . 2. The fee owner used this area to fulfill the City's park dedication requirements even <br /> though this does not appear on the Abstract of Title. <br /> . Lindy's Park <br /> Again, Attorney Filla believes that the fee title to this area was in the name of John J. Kenna, Jr., <br /> . subject to the two following limitations: <br /> 1. The City of Arden Hills condemned the right use of this parcel as a public park and open <br /> . space. The City has the right to use this property for a park; however, the fee owner is <br /> John J. Kenna, Jr. <br /> . 2. The portion of the southwest comer (100 ft.) is still subject to a Ramsey County road <br /> easement if the City chooses to vacate the area for park purposes. <br /> . Conclusion <br /> Attorney Filla concludes that the City of Arden Hills does not have the right to convey either <br /> parcels of property for development purposes. I have attached a copy of Attorney Filla's report. <br /> . <br /> .e <br /> . <br />
